I asked if Bush could still be prosecuted for his absence from the NG.

From The US Military Uniform Code of Military Justice (UCMJ)

Article 43. STATUTE OF LIMITATIONS
(a) A person charged with absence without leave or missing movement in time of war, or with any offense punishable by death, may be tried at any time without limitation.

Now, we all know that if roles were reversed, the rabid right would go after Kerry full force on this issue and try to bring charges. I think the Democrats should do the same to Bush to make him and the rest of the right-wing defend his lies and cowardice. While it would be a risky political move, it would be justice served and would assure, at the very least, that Bush would be an incredibly weak president in the event he steals another election.

Let's remember that the right-wing argued that Clinton's "crimes" would have gotten him dishonorably discharged from the military. Well, then, I'm sure they'll feel it's only fair if Bush is subject to the same sort of penalties that an ordinary soldier who was absent without permission during wartime would suffer.

If Bush broke the law, he should be prosecuted.

To be honest, I don't want ot prosecute Bush for anything as insignificant as shirking his Guard duty. He's done far worse things than that and more recently.

8. Hate to Burst the Bubble, but
Vietnam was NOT a "declared war". Congress never voted on a "Declaration of War" over that mess. There fore the death penalty does not apply and therefore the "without limitation" portion of that Article does not apply.

And if you think the Bushies wouldn't hire a fleet load of lawyers to drive a convoy of pulp trucks thru that loophole, you're nuts!

The American people don't really like when someone's not convicted as a result of a technicality. The point is, the impending trial would drag that pig through the mud for month after month.

I think of all the soldier's who are dying for a war that was started by a boy trying to please his father or all the criminals who received the death sentence, despite, in some cases pleas from the left and right. In memory of those people, Bush should be exposed for what he is.

IMHO this would never see the inside of a courtroom.

I do agree with your last line ("In memory of those people, Bush should be exposed for what he is."), but I think the best way to do that is to remove him from power and let the vultures of history take over.
