2. It is IMPORTANT to get YOUNG JUDGES ON THE COURT!

It is VERY IMPORTANT to get young, brilliant progressive judges on the Supreme Court. We should encourage the members whom are retiring to retire in the first two years, so we can have an UNSTOPPABLE nomination.

That nominations should be given to progressive judges who are under 30 years of age, if possible, and will commit to staying in great shape all of his/her life so that we can have at LEAST a half-century of consistent, progressive interpretations of the US Constitution. If we can get at LEAST two judges to leave during the first two years, then we can ensure that we can legislate from the bench if necessary.

In addition, we should fill EVERY judge vacancy with young, progressive judges as soon as possible. I would submit that we should put a litmus test on the ages of federal judges at 40. This should be a HIGH PRIORITY, and we should fill out the federal slate of appellate and regional federal judges by 2009.

3. FDR had to deal with a largely conservative Congress and a RW Supreme Court.
The Court was his greatest impediment and we suffer as a result even today. Your post is right on.
