Berg Case is not on Cert granted list
It appears that neither of the two Obama birth certificate cases were granted cert by the SCOTUS. Neither are these cases are on the cert. granted list http://www.scotusblog.com/wp/wp-content/uploads/2008/12/orders-12-5-08.pdf

Actually it doesnt! It does not mean that they have denied anything just because the case wasn't put on todays list. From what I've heard, they may not know until Monday. Heck, Berg hasn't even found out anything yet. He still hasn't had his case listed as denied and his was on December 1st.
