RELITIGATE?? When did we ever litigate torture in the first place?
I don't know how many talking heads have mentioned that we might not want to "relitigate" this ~ don't you have to litigate once in order to relitigate???

The nearest to something actual they could mean is that the memos written by Yoo et al were in some sense 'litigation' that established actions which were clearly felonies under U.S. law, and grave breaches of international humanitarian law, 'really' were no such thing....

4. they're just looking for an argument that they can win!
they can't really admit that torturing people is the right thing to do because they can't win that one! They have to make an argument saying that torture produced desired results. And really, they can't win at that one either since much of whatever proof they might use is classified!
