Um, isn't like ALL prosecution *everywhere* BASED ENTIRELY upon "looking backward"? I mean, it's not like you have a precognition crime unit somewhere like in Minority Report, right? Are you arguing that nothing should ever be prosecuted? If not, then there must be something *special* about *this* current torture situation that preclude prosecutorial looking back. Please tell us what it is, because the "looking back" argument on its own would seem to prove too much.
