ARTICLE 2 VOTING, INITIATIVE AND REFERENDUM, AND RECALL


SEC. 14. (a) Recall of a state officer is initiated by delivering
to the Secretary of State a petition alleging reason for recall.
Sufficiency of reason is not reviewable. Proponents have 160 days to
file signed petitions.
(b) A petition to recall a statewide officer must be signed by
electors equal in number to 12 percent of the last vote for the
office, with signatures from each of 5 counties equal in number to 1
percent of the last vote for the office in the county. Signatures to
recall Senators, members of the Assembly, members of the Board of
Equalization, and judges of courts of appeal and trial courts must
equal in number 20 percent of the last vote for the office.
(c) The Secretary of State shall maintain a continuous count of
the signatures certified to that office.

Almost 9.5 million people voted in the last gubernatorial election. Of course you would want to get a good deal more than that, becasue some of them will likely be invalidaded (illegible, same person signing twice, not a registered voter).

They are as safe as any other state in the union. If anything, having the issue come up in Nov is the best opportunity to get rid of Arnold. He won in a special election, which have notoriously low voter turnouts. The presidential election will bring people to the poles, and the more people who vote, the better the Democrats do.

I agree that it would be a BAD idea to get a "recall Arnold" movement going before the November election, because very much unlike his predecessor, Arnold is still widely popular with a large swath of the California population.

He is not making a film about Tony Blair and never was. He is mad at him though for supporting Bush because, like he said "Blair is not an idiot. What is he doing hanging around this guy?"

Moore's next film is already in the works. It will be about the healthcare industry. The working title is "Sicko".

Camejo recieved less 3% in the recall election. If the margin between Bush and Kerry is that close in CA, he has no chance on winning any of the swing states.

30. I agree its unlikely.....
But one has to consider a few things

Nader got 418,707 votes in CA in 2000. Add Camejo who has name recognition in this state and those numbers are likely to rise. How much of effect would be debatable. Even if you throw Nader voters behind Bush, Gore still beat him by 800,000.

Another unlikely but possible scenario is Nader vote trading &/or bolstered support because CA is considered safe. Granted if the polls show Bush within 5 pts this shouldn't happen but you never know.

Alot can happen between now and Nov. Again, this worries me more now with Camejo though that is likely just jitters about the election in general.

I'm presently unemployed and am very short on cash and gas, but I might be able to help, at least by signing a paper.

Although, to be honest, he hasn't pissed me off as much as Bush has. The major thing that he did that fucked me over was raising tuition on everything, the community college cutbacks made it so I can't go to school this year.

9. Yeah, that's true.
But at the very least he doesn't act like a complete moron. He has a excuse to have a accent being Austrian, but can at least speak English at a 12th grade level. And he seems willing to compromise with the Dems. Instead of simply taking a absurd worker comp package to referendum he actually worked out a compromise. That and he's getting kinda pissed off at Bush too, hence why he'll only campaign in CA. And you know what, repealing that car tax actually saved my bacon, I'm not sure how I could have paid it in my current income bracket.

Now here's the real differance between him and Bush. I can actually say a few good things about Arnie, I can not say ANYTHING good about Bush.

....NOBODY is worse than the Chimp.

However, Ahnuld is an asshole. He should have left the vehicle tax the way it was....how much did YOU get back...my checks totaled approx. $40 refund.(It wasn't a tripling of the tax btw...another lie.)
The people with Hummers and gigantic NEW SUVs (for which they got tax breaks) were the true beneficiaries. And if they could afford to buy such expensive cars in the first place it was indeed a FAIR tax. The rest of us got back a pittance. Now services in Police, Fire, DMV, social services and for the children he professed to love SOOOOO much have been cut. My son's tuition has tripled. Gas in my neck of the woods is $2.69 MINIMUM......and now the bastard wants US to pay ENRON et al MILLIONS after they bilked us of BILLIONS!

He is cutting social services and enabling his rich buddies to come on in and steal from us.....now, who does THAT sound like?

He only got 48.6% of the actual votes cast....hardly a bloody mandate. Of course Orrin wants him as prez in 2008 so will now introduce legislation to allow foreign born citizens to become president. I barely consider Texas part of the USA...sorry Texans.
I don't understand his 65% approval rating when all he has done is yell, "ackshun, ackshun, ackshun!" and "Buy Caleeefohrneean!"

This is the same man who said he would NOT accept PAC money...see graph..PAC Boy personified! And he just can't remember AT ALL that special meeting with Kenny Boy and all the other energy CEOs.

14. Sympathy for the devil here
I've found Arnold to be more responsive than any previous Governor. Here's my anecdote to show what his opponents are up against:

I applied for unemployment benefits in February. My first check arrived about February 23. On the same day I received it, I also got a separate mailing from the Employment Development Department (EDD) that had a full sheet of paper, same form as the check/Continued Claim form, just to tell me that I didn't get paid for the first week because the law requires it to be a "waiting period".

I've collected UI several times, and the fact of the waiting period has been communicated several times already. There was no obvious reason that notification needed to be in a separate mailing. That one sentence could have been printed on the same form as my check stub, or a reminder of the waiting period could have been enclosed as an inexpensive pre-printed stuffer. I did a quick calculation and determined those extra mailings are costing the state close to a million dollars annually, maybe more.

I wrote a specific suggestion to change the EDD's statement rendition to avoid the extra mailing. (I worked as a systems analyst for a bank for several years, so I know how those things work.) I addressed it to Arnold and sent it to him.

Did Arnold send me a kissy-ass reply with a signed portrait? No.

Did Arnold have a staffer call me to thank me for my suggestion? No.

Did Arnold blow off my letter? No.

Did Arnold waste any time replying to me directly at all? No.

Three weeks after I sent my letter, I got a phone call from a SYSTEMS ANALYST at the EDD who had my letter in hand and wanted to talk about it. A mid-level $50K per year type guy who was doing work similar to what I used to do in banking. He asked a couple of questions for clarification then expressed near perfect agreement with my suggestion, and said it could really save the state a lot of money. He said he'd take it to the EDD's manager in charge of automation.

If my experience reflects how the guy does business, anyone who wants to throw him out of office for whatever reason has a long row to hoe. Fiscal responsibility is at the forefront of a lot of Californians' minds right now, and we all know how forgiving voters can be of sexual improprieties. If the Schwarzenegger Administration is perceived as taking an appropriate course to handle California's financial woes, any recall effort is going to look at best like the loyal opposition half-heartedly fulfilling its obligation to perform its role as adversary. That's enough reason to suit me, but I advise you to be very careful to stay on the high road. You could get burned. Arnold is a RINO. A recall may not be in the best interests of Democrats in general.

16. Caution, Arnold could swing further to the right
If we can get Arnold recalled in November when the true liberals flood to the polls to vote against Bush, it will be simpler than trying to recall him in a low-turn-out election.

I think he's playing enough to the left to get through the November phase, but he could do a U-turn after the elections.

but how does obligating our population for billions of dollars that go out of the state to NYC underwriters in interest for mine and your lifetimes when we could have raised the sales tax 1/2 % and saved hundreds of millions in interest paid out over 35 years square with the fiscal responsibility angle? The same underwriters who underwrote Enron? Who threw a "fundraiser" for Arnie, 10,000 bucks a plate , in NYC , no Californians allowed? Call me sarcastic, but I don't get a lot of warm fuzzies from your apocryphal tale.

25. I'm glad he helped you...but.....
...I've had congressthing Elton Gallegly as my revolting rep. for more years than I care to remember. I have written to him on numerous occasions on issues ranging from abortion to ___________(choose your liberal cause here) and received efficient "responses" from his staff, basically ignoring the content of my letters.
HOWEVER, when I contacted him about benefits for a Vietnam vet friend of mine who now is dying of leukemia due to handling Napalm years ago....the response was VERY swift... Gallegly has a superb staff...and the VA was immediately contacted and my friend's benefits restored. The VA doctors had determined that he "wasn't sick enough" to get medical coverage.
I think it depends on two things:
1. The topic
2. The efficiency of the staff.

So, while I don't discount the fact that you were helped by Ahnuld's office....I think they pick and choose, based on their politics, to whom they will respond and act accordingly. Form letter vs. actual assistance. No need to run for cover. :) Ahnuld will probably continue to be responsive for a little while...until the number of letters of despair increase...then it's back to form letters.

Perhaps if I write to Ahnuld about my son's increased tuition he can help me out? But I doubt it.

...over the years I have found Feinstein's "staff" to be more efficient than Boxer's but when Boxer's people DO get around to answering, the replies are more substantive. Feinstein's are always "canned" letters.
The BEST and fastest response I ever got was from the Clinton White house during the Starr Witch Hunt when I sent a letter of support for MY PRESIDENT to hang in there and not let the 'b@stards' get to him with their hypocritical vast right wing conspiracy.

Who the "staffers" are say a lot about the person. (I think...but I could be wrong. :silly: )

But, all congresspeople are supposed to do constituent services.

It's the only thing Elton's known for but it's not a good enough of a reason to send him back to Washington time and time again. I know how close the numbers are here, and even if both bases turn out in force the edge has gone to Gallegly every single damn time. But he doens't represent all of us, and he's never represented me.

We do finally have a great candidate who can run rings around Elton in every category you can think of -- and I think he'll also perform his constituent services well, especialy if he has a great staff (as you know how important that is). Please give your support (and tell everyone you know in the 24th CD) about him.

36. We're on the same page regarding Gallegly...
...it's almost as if he runs uncontested each time. He's a virtual "shoo-in" thanks to places like Simi etc. And we have a large military presence here as you well know. I have always voted for whichever Democrat was running against him. See the "D" and vote for it. I don't even remember half of the names.
Heck, they even gerrymandered Carpinteria into his district several years ago...when I used to live there....or I would have had Capps. SB usually goes Dem...Vta usually Rep. Now that I live in Ojai I'm firmly in his territory. I've almost given up hope of ever ousting him from the public trough. He does get those contracts for the military types. And he works the agriculture angle very well too. He's got it down. He has no need to serve people like us. Just like Chimpy he has his core/base support with dough ready to help him each time. And he keeps a low profile.

His office is great at the response thing. I suppose that IS his basic job....constituency responsiveness. But I swear to Hades that a few years ago, when I wrote to him about pending abortion legislation, he (his office) wrote back to my SO instead....as if "the little lady" needed a talking to. While amusing, it was also rather scary to think he went to "the man of the house" to discuss HIS concerns about abortion with another MAN rather than back to ME, the airbrained uterus owner.

Thanks for the link to Wagner's site. I'll look into what I can do for him here in Ojai. :)

35. The State of California has done business in that manner for some time....
You send a letter to a higher level of some sort and they will buck it to the State agency and in turn to the person most in a position to take some action on it or explain exactly why it is not a good idea. A telephone call or letter goes out to the letter sender.

Nothing new about that.

37. Hey Slack, I have some rather positive things to say too...
I may be mistaken but didn't we just hear something about Arnold NOT running a second term here in Cali?

I have to say that I'm sad that so many things were cut from the states budget. Schools suffered a lot of things suffered. BUT, like you, I'm shocked to learn some positive things under his "command".

Maybe I can put it another way: I learned something VERY undemocratic about Davis lately. It has to do with the proliferation of prisons and prison guards wages. Davis was MUCH harder on ALL crimies than Arnold. Arnold actually wants to REDUCE the bloated budgets of our domestic "torture chambers". I heard that there was a move to close about four prisons...not sure if that went through. I also heard that prison guards were going to have to take a pay cut or something akin to that.

Under Arnold, I'm hearing murmurs of changing the way we do prison business. Stop sending lightweight offenders to prison (it costs the state a fortune)...stop the yo yo parole cycle. Try using other determents and use after jail programs to help inmates re assimilate back into society. Apparently, Davis didn't give a shit about this type of thing. If you farted in church, you go to jail. That's not the kind of democrat I am and never want to be. There is a move to try to clean up these corrupt systems...I hope they make it work...we shall see...

The reason I bring this up is because (of course) I have an adult daughter in Prison. She is living a nightmare there. It's a drug charge mind you, NOT terrorism, or murder, or Ken Lay rip offs...I've been looking into some pretty active Prison focus groups who equate some of our prisons with what we saw in Iraq. The mindset, that is.

Fat prig! He has gutted so much in this state for the common everyday people when he didn't have to. The car tax is a fraud. It was just a ploy to get Davis out of power then set the Furher up for the next Prez. Gawd almighty. The car tax wasn't an increase. We had a roll back of them earlier with the instructions that if something came up and we needed them again, we'd reinstate those same taxes again. They weren't suppose to be NEW taxes, just the same taxes that had been put on hold--so to speak.

Now, schools are closing, fire, public services of all kinds are being cut, health care services are being cut, ...he's just hacking and hewing away. He borrowed MORE money from people he will obviously get a kick back from for his purposes later on. He's a fake.
The only thing I can say positive about him..........MAYBE is his alleged stance on emptying out the prisons of non violent offenders to save the state some bucks. We'll see if he follows through. Even the after care programs for ex felons are being cut. Housing vouchers are being cut. Shall I go on??????????????????????????
Shit, Davis could have stayed in place and done that and saved us a huge money busting, nerve wracking re call election!!

Frankly, hes not doing that bad a job either. The state senate seems to be cooperative/too scared to challenge him, and its about f-ing time! We recalled Gray Davis because, as governor, he had the nominal chief seat on the University of California Board of Regents, and because the state lawsuits against Enron, Dynegy, Reliant, Williams and other Texas energy pirates, which sucked billions of dollars out of California in illegal scams, had been consolidated with the U.C. system as the plaintiff. We recalled Davis because Ken Lay and George W. Bush and Dick Cheney could not afford to see this consolidated lawsuit get to the discovery phase, so the recall was fast-tracked and a right-wing actor stooge, with fantasies of becoming a dictator just like another homeboy from Der Osterreich, was drafted to suck up the state's stupid vote and replace Gray Davis, then kill the Enron lawsuit.

What was one of the first things Herr Schwarzenegger did upon being sworn in? I'll give you one guess.

Look, pal. I know it's hard typing that crap you posted from G.O.P. squawking points, but realize you're not dealing with a bunch of dummies here. We may wait until the next election. Or we may be so emboldened, with the election of President Kerry, to accelerate the process and boot that sawed-off, orange-tinted, Hummer-driving, steroid-damaged Nazi out of Sacramento and send him back to Hollywood, where he can get botoxed and eyebrow-plucked and pussyass-pampered with the rest of his girly-man buddies, sometime in 2005. It was not a direct result. It was certainly a factor. But rises in spending between 96-00 and a dramatic fall (post-99) in tax revenue (especially from the highest tax bracket) were bigger ones.

Enron was ahuge factor, 9/11 cost us a great deal of sales taxes due to tourism, the collapse of the tech sector due to inflated IPO's thanks to banking industry manipulation were ALL sources of loss of revenue.

The spending was MODEST comparatively and the MAIN problem that tipped that over the top was healthcare costs outpacing inflation by double digits...something unforseeable by Davis when he extended healthcare benefits for state workers.

Since the dawn of MediCare, benefits have always cost far more than projections. That doesn't change what I stated which was the bigger factors in the deficit being rises in spending(we can call it costs to the state if you're more comfortable with that phrasing) and a fall in tax revenues(while I didn't specifically mention it I would include tourism tax losses there.). There was in fact a dramatic drop in tax returns filed from the highest tax bracket and the revenue from such of course dropped as well.

Maybe you should have told that to the people who were trying to recall Grey Davis. So who's the girlie man now!!! Excuse me what things are getting done by Arnold. California's deficit is larger now than under Davis. In addition to having a larger defecit now the people of California will be in debt for many years and their children will have to pay for the money Arnold has borrowed. I do not think it is good for democracy when state senators are too scared to challenge a governor. And do not call people silly little twits. Finally, Arnold has broken just about every promise that he made to the people of California. It seems to me that you would be upset that a governor broke just about every promise he made on the campaign trail. It also seems that you would be angry that Arnold made such a big deal about not taking money from special interest groups and then turned around and took a record amount of special interst money in the first few months of his administration.

Now it should be apparent to you the Governator is ineffective and only involved in the same thing as the other rapacious capitalists loosed on California by Bushco: transfer of capital and wealth away from here and into the coffers of an offshore banking entity.

Such pathetic spouts are clear cover for these modern day pirates,the primary reason that the people are screwed once again; because nobody bothers to do any heavy lifting intellectually, just blort out a catchphrase they want you speak for them.

The SAME banks that made billions in interest and fees off the Enron company, then extended banana republic junk bond rates to finance California's sudden Enron related power debts, these SAME banks, these SAME banks paid off Arnold's debts in a private "fundraiser" held in New York City, then got the underwriting of the NEW debt. Instead of a California firm getting the underwriting and servicing fees,keeping at least 150 million in the state, it goes to a bank primarily controlled by Saudi Financial interests.

Never mind that the whole thing is covered on the backs of your grandchildren ala the national deficit; or that a 1% TEMPORARY raise in the sales tax , Phil Angelides' plan, would have paid down this debt which was unjustified in the first place. Never mind that Governator settled our claims of fraud against the power companies for pennies on the dollar. No, what's important is that we get retread "Hans and Franz " quotes when trouble pops up, because after all, isn't quality entertainment more important than actually putting a stop to this permanent money flow out of the 5th largest economy in the world to the coffers of an international oil based power controlled by foreigners like the REST of our national debt is?

Now, who's the twit again?
No. Let me rescind the twit reference. By now, I'm sure a new and better talking point will emerge on the Fox channel.

I didn't vote for Ah-nold, and basically think he's a scum-sucking piece of shit. But this overuse of recalls is getting a little tiring. I didn't support the last one because I think something like a recall is only supposed to be used in extreme circumstances, like when a politician has committed a major crime. Davis, scumbag that he may have been, didn't, at least no more than most politicians do. And the same is true of Arnold, at least according to the laws we have set up. Personally I think being a whore for big business at the expense of the people is a crime, but not one that you can be prosecuted for.

While I would absolutely love it if Arnold was to get his ass booted back to the gym and the next Terminator sequel where he belongs, I really think that trying to get him recalled at this point in the game is rather petty. I know you mean well and I share your distaste for Arnold, but I really don't want to see the state have to go through this kind of thing every year because we don't like our leaders. If Arnold commits a major crime like Bush has, I'd feel different. Until then, let's live with it and try and find somebody of substance to replace him next election.

I was against the recall and voted for Camejo. But now that he is in office, my impression of him thusfar is, he's not so bad. Granted, I have not been following him or the California story like I have the national one. But I believe he's got a pretty good environmental record so far, and that gives me warm fuzzies. I still think he's a Democrat that doesn't know it. Or an old-school republican, the kind we don't see any more.

54. I signed the petition for this but I have to admit that Arnuld is
too popular for this effort to work -- just getting the million signatures in 160 days will be tough. It could just back fire. If he wins a recall effort big, he will be more powerful and impossible for the legislators to work with.

55. He has to be recalled. If not this will become a back door
for legitimate elections to be overturned at every step. You can't see the future can you? How do you know he will be bigger and more powerful and impossible to work with?
