A Dallas appeals court on Monday rejected a lawsuit by state Sen. Kim Brimer, R-Fort Worth, that asked the court to remove his Democratic challenger, former Fort Worth City Councilwoman Wendy Davis, from the Nov. 4 ballot.
Brimer was appealing a ruling made in July by state District Judge Tom Lowe that Davis is eligible to run for the state Senate District 10 seat.
A panel of three justices heard oral arguments last week from Brimer’s attorney and lawyers representing Davis, the Texas Democratic Party and Tarrant County Democratic Party Chairman Steve Maxwell.
"The law is clear that a challenge to the candidacy of an individual becomes moot 'when any right which might be determined by the judicial tribunal could not be effectuated in the manner provided by law,’ " Justice Mark Whittington wrote in the opinion released Monday.
