I know there are other threads that have this information buried inside, but I though it warranted its own thread. A voter in Volusia County, Florida (working with BlackBoxVoting.org) has filed a lawsuit against election officials and has requested that the results of the general election be "set aside."
Here's a link to the full text of the complaint that was filed:
http://www.blackboxvoting.org/volusia-lawsuit.htmlTo highlight some key things, note the following:
Officially signed poll tapes that were requested by BBV through FOI requests were found in the garbage. Those official poll tapes have different vote counts than the unofficial copies that the election officials gave to Bev and her group.
In addition, there was a GEMS server (i.e., cental tabulator) that was not supposed to be networked. Yet BBV has concrete evidence that it was networked, and has logs showing attempts to access the server remotely. Low and behold, the vote counts on that server differ from the original counts sent from precincts on election night. In some of her comments in the General Discussion area, Bev points out the following:
"Oh yeah, and we intereviewed poll workers. On camera. Showed them the poll tapes we were given by Volusia County. To a person, they said, with great concern, "That is NOT what we submitted to the county." One remembered the results on his poll tape. What he remembered, before ever seeing the results tape or hearing what was on our copy, was not the same. His memory for a precinct with a tad over 400 voters had 60 more votes for Kerry. Of course, that's not legally binding, since he hadn't written it down."
