Marine deserter fighting extradition

A Marine who deserted from a Camp Pendleton, Calif., infantry battalion in 2006 is in a legal limbo after his arrest Sunday in Port Angeles, Wash.

Lance Cpl. Lance Hering, 23, was jailed and now faces extradition to Colorado, where he faces charges on two separate arrest warrants stemming from a probation violation and his part in a hoax that led to a massive, four-day search by Boulder, Colo., authorities after a friend claimed Hering was injured and lost in a popular rock-climbing area.

Hering’s lawyer, Alex Garlin of Boulder, told the Rocky Mountain News that the Marine intends to surrender to the military.

“This was on Lance’s volition, his determination, his act as an adult, knowing that there are only certain ways he could start to get all of this behind him,” Garlin told the newspaper.

Hering, sporting shoulder-length hair, appeared Monday in a Clallam County, Wash., court where a judge set bond at $5,000 and ordered him to appear at a hearing later this week. His release is not likely, however. Along with the two warrants pending in Colorado, federal authorities had issued an arrest warrant for deserting his unit, Kilo Company, 3rd Battalion, 5th Marines.
