Are you talking about a case when someone steals another's images? Where someone takes a photograph of someone else's private property? Where someone has a hidden camera, and is photographing an occasion where they were not supposed to be doing so? "Photos being obtained under false pretenses" is an extremely broad category, which really can't be answered without clarification about your particular situation.
