My husband was on jury duty recently in a DV case. He was so horrified about the case he's taken it upon himself to attend the sentencing. The man in question was convicted on all counts. Now, I can't ever describe or explain my husband to anybody. He's one of those people who seems to live in a constant world of serendipity as well as synchronicity. I say that because people tell him things or give him things or he meets the oddest people.

Anyway, the prosecutor gave him a copy of the first letter of the convicted abuser prior to sentencing. The letter got the guy a continuance. She called him about this current sentencing. My husband went down there again, and the man has gotten another continuance, because of another letter he had written and because he called and threateded a witness. This first letter is now part of public record, so I thought I'd share it. It's hand written, I didn't feel like messing with HTML, so the capitialized words are actually underlined in the letter, I've left any mistakes in.

"To the Honarable (name left out)
Your Honor, I am (name left out)and Stand to be Sentenced in you courtroom on 3/11/10. I offer this letter instead of speaking before you to save time and also to be more articulate in my thoughts.
First I'd like to say, without fluffing your frock, that I found your style at the bench first rate. Intelligent, informed, fair and most of all appraochable (real) I commend you and am thankful for it.

Next, as far as the findings of the jury I still maintain my innocence, and I shall appeal. I've never been to trial before, I was however alternate Juror on the Kevin Coe rape trial in Spokane. In all other matters before the court, unfortueatly, many, I've taken the Deal, either because I was guilty-or in order to be released from jail. In this case I Couldn't with good conscience do that. Now as far as the original charging papers, I would have plead guilty and taken 100% responsebility for my actions.
These was no way however that with a Burg 1 and Assault 2 I would Admit guilt. When I refused the "Deal" They Added the Aggrivated on the Assault 2. In my past experience, which as I mentioned is a lot-the prosecution Always Came to Me with a lesser Charge, which I've Always Agreed to. None was forthcoming. It wasn't until After the Jury was Decided upon that the prosecutor Announced that the charges were without the Assault 2 Aggravated. It was never offered and Had it been, I certainly would have More than Considered pleading out to it. Be that as It may, I beg you for the low end of the Sentence, And Throw myself at your Mercy. I Still May Something Short when asked or Not(?)
Or Not. Lastly, I will Make it known that as far as (name left out) is Concerned. I LOVE her, MORE NOW THAN EVER. It will NEVER change. To think that I would ever really try to hurt her, let alone "kill" her, is Completely Absurd. I think thatin the 18 years together I woud Surely have Accomplished it had I Wanted to. (which I Assure you I never have)

She testified She still has feelings for me. I testified the same and it wasn't perjury. Come to thing of it, EVERYTHING that I said was the TRUTH--Yet CONVICTED I am. Anyway, back to the Original thought. When and and I know she will, (name left out)appears to you to provoke any protection orders, I beg again for you to oblige her--Coming to visit me in Prison is probably the SAFEST place for a visit. And there are otehr reasons to Allow letters and Such. We Are Family. He mom, my mom, out son my kids, I would like to be able to send or Direct Birthday presents--Christmas Prsents etc. I would be so thankful Even If you were to consider them. Of Course only If she asks. That you So Much fo your time. I know your very Busy

Ok. This guy by all evidence--most of which was left out in the trial-- had been beating this women for the entire time they've been together. It's a sad, all too common story, involving drugs, kids taken away etc. I wanted to share the letter because it gives a bit of insight into the mind of a chronic abuser. The prosecuter is asking for an exceptional sentence. Both the prosecuter and the judge seem to appreciate my husband showing up and taking an interest. (He brought my grandson this time, so he could see some of the legal process) My husband honestly thinks this man will kill this woman if he isn't locked up. The procecutor told my husband that the majority of these guys walk. I have some of his history before me right now, multiple beatings without procecution or conviction.

These are the charges he is convicted of in the trial my husband participated in;

Burglary in the First Degree as an Aggravated Domestic Violence offence, Felony Harassment as an aggravated Domestic Violence offence, and misdemeanor Interfering with Reporting of a Domestic Violence Offence.
