ASSUMING we do re-take the house... wouldn't this 'end' Shrub's ....

1. Pass a resolution (not a bill that DumbNuts has to sign) that states "there has not been a 'Declaration of War' by the congress, and only the Congress has the power to declare war. Therefore the "War on Terror" is a non-sequiter.

2. Since there is no "Declaration of War" then DumbNuts has no "War Powers".

3. Since there is no "Declaration of War" then the congress ORDERS DumbNuts to bring the troops HOME.

4. Since there is no "Declaration of War" then the Torture Bill becomes 'inactive', habeus is returned, DumbNuts is no longer 'retroactively immune' (since there never was an offical "Declaration of War") and we clean out Gitmo and get some honest trials going and find out what's what.

Q.E.D. (???)

3. The Military Commissions Act can only be abolished or struck down
It can't be stopped through edict alone. You have to repeal it like the Espionage Act was repealed after the end of Woodrow Wilson's presidency, or you have to have the SCOTUS strike it down with extreme prejudice.

8. Easy. Pass a law repealing it.
You need both houses of Congress, though. The OP's assumption is that only one house is won, not two.

9. Thanks Selatius.
Should we take both houses, do you think it will be repealed or will they amend it to preserve Habeus Corpus.

Just today, Rangel said they wouldn't repeal the tax cuts if Dems took Congress. Some time ago, another Democratic leader said they wouldn't start impeachment proceedings if they were n power. I'm just wondering if maybe this is the beast they will repeal.

10. I vote for repeal, but moderates may simply go for amending it
As far as Bush's tax cuts go, I say add in a new tax bracket at 45 percent. Aim it at those who make 1,000,000 a year and higher.

5. I would hope you are right....
But I remain skeptical. I don't expect changes regardless of which party becomes the majority. I watched Chris Matthews last night on Leno and he said to the effect that we will be in Iraq the next two years. And it will be up to the next president to decide when to withdraw. If you don't like the current situation the send a message, but if you do like it then vote republican....
