McKinney cannot be arrested.
Section 6. Clause 1. The Senators and Representatives shall receive a Compensation for their Services, to be ascertained by Law, and paid out of the Treasury of the United States. They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.


In 1998, 84 Representatives and Senators were released after being stopped by police for driving while intoxicated, clear breaches of peace and felonies. All the members claimed congressional immunity.

2. cite to the arrest factoid?
Because I don't even think that many congressmen drive themselves, much less get stopped. The clause seems pretty limited in time, and besides, DUI can be a felony and is excepted.

3. They can be arrested
after session. Many have in the past and will in the future be arrested for criminal acts. This only covers them during session.

5. I think Tom DeLay would have to argue with that statement - it only
applies to them coming and going into session, so that they can't be prevented from doing the business they were elected to do.

Now, just because you're on her side, you're making a case that she's above the law.
