Pardon me, Mr. Obama, I'm not a Harvard-Educated Lawyer, but I'm pretty sure, if a person gets a subpoena to testify in court, it's pretty much a sure and legally certain thing he's gonna have to testify...

People can be called to testify as witnesses without being subpoenaed, and they have the option to refuse.

A subpoena would be something else entirely, but that wasn't the question.

4. You certainly AREN'T a lawyer.

Even if the defense puts you on a witness list, it is not automatic that you would be asked to testify or be served with a subpoena. Chances are, if you haven't been called in to provide testimony as part of discovery, the judge in the case would have to have compelling reasons why you would need to provide testimony at trial. Even if you are called to provide a deposition during discovery, if your testimony offers no probative evidence to the case at hand, you probably will not be compelled to testify. If the defense wishes to call you as a character witness, it is very unlikely that they would compel your testimony on the stand.

At least take some law courses before you start spouting nonsense.

See, in the news articles that have come out, there has been talk of Obama possibly being subpoenaed to testify.

I may not have shaved the frog and split its fine hairs between the talk of subpoena and the interviewers polite question, but again, and I made no pretense of being a lawyer, Obama never gives straight answers and he IS both a Lawyer -AND- Disingenuous.

That's the point, not the legalese distinctions made by lay-people.

would certainly want to consult trial lawyers before making any moves. I'm sure he knows all that I explained, but being a good lawyer and smart person, he would hire a top notch group of trial lawyers to explain all of his options to him. Your OP implies that he HAS no options and "knows it". My post is to explain to you that it isn't all that cut and dried, he does have options depending on how his name comes up and WHEN his name comes up. My understanding is the the trial phase of the case has begun, and that means that the discovery phase is over, so since he wasn't involved in the discovery phase, I think he has a number of options should he be asked to testify.

BTW, making your posts in 30 point fonts doesn't make your case for you.
