I agree completely with everything you said.
The president said, "nothing will be gained by spending our time and energy laying blame for the past". I've always had the impression that this is PRECISELY what the justice system does. Laws were broken, crimes committed, the risks to our troops increased, and the image of Americans as the "good guys" temporarily (I hope) trashed, but forever tarnished. The evidence is undeniable. It's all there, literally in black and white. It couldn't be more clear.
This is a big issue for me as an American. It's been eating at me since I first heard we were torturing suspects as an official policy in 2002. Maybe there's some grand and convoluted strategy at work here that will bring all this to a satisfactory end in the near future. If so, then fine. If not, however, this is a deal breaker for me. Torture is a crime, and "accessory after the fact" is a crime as well.
ACCESSORY AFTER THE FACT - Whoever, knowing that an offense has been committed, receives, relieves, comforts or assists the offender in order to hinder or prevent his apprehension, trial or punishment, is an accessory after the fact; one who knowing a felony to have been committed by another, receives, relieves, comforts, or assists the felon in order to hinder the felon's apprehension, trial, or punishment.
