The Senate Judiciary Committee is set to vote this week on the nomination of Leslie Southwick, a former Mississippi state court judge, to the Fifth Circuit. The ABA has rated Southwick as well-qualified. The New York Times editorial board and Slate’s Emily Bazelon don’t think so.

The Times says that “after his performance as a state court judge, it would be hard for a black person with a discrimination case, or a gay person with a family law issue, to have any confidence that Judge Southwick would treat them fairly.” On Slate, Emily Bazelon says that at Southwick’s confirmation hearing, Sen. Dick Durbin (D-IL) asked him for an example of an unpopular decision he’d made in favor of somebody downtrodden. “Judge Southwick couldn’t name a single one,” she reports.
