I have a LEGAL question for all of you.
My brother worked for a security company in Cincinnati called Cal-Crim. He loved his job, do it diligently and with much enrhusiasm. A few weeks ago, he called to tell me he got fired because another employee claimed he pointed his gun at him. I know my brother and I know he doesnt do that stuff, He told me he would never point a loaded weapon at anyone in jest.

Well he just found out this evening, that the VP of Cal-Crim had him put on the Blacklist for security jobs. Meaning he cannot get ANy security job in the state of Ohio. Apparently the VP is part of Ohios Board of Security or something to that effect. Now, what I want to know is, how much of a chance does he have persueing legal action against Cal-Crim?

1. You Have to Ask an Attorney Licensed in Ohio
A general question like that -- no ethical lawyer on DU could answer it. I'm licensed in California myself - and I have no idea of the answer to your question under Ohio law.

2. Well
Laws aside. Lets say on the basis on Slander and untrue accusations, then the VP persuing the action of banning him from working any security jobs, based on that slander... Would he have any options?

3. Did they tell him specifically that he was fired
for drawing his firearm? And is that standard protocol for the company to terminate someone who removes their service weapon.

4. Yes
Thats why they fired him. And im not sure on that part, but he kept his handgun loaded at all times, since he worked third shift in Cincinnati, especially in the... wrong neighborhoods like Over The Rhine.

The fact is, he DIDNT draw his firearm to point, he drew it to show it to his fellow employee. whom apparently had it out for him. At the time im sure it wasnt loaded, that would be dangerous and my brother is a very careful person, having 4 kids. I know my brother wouldnt lie about showing or pointing his weapong at someone. He went throw the CCW Classes ( carry and conceal ) and has his license, so he learned what to do and what not to do.

It just tears me up, because my brother has a wife and 4 kids, and is on medicaid because of diabetes and now he's having trouble making ends meet.

5. Thats terrible
and Ohio is not a Right to work state so he has some legal rights there but you'd have to prove slander and that's pretty hard to do. Also most lawyers would ask questions about retaliation. If he was singled out for it and can prove it he was fired as an act of retaliation then definitely get a lawyer. There are probably a few law firms that would listen to his case for free too and give advice.
