1. hmmm-- the first option is perhaps overly restrictive....
The war against Iraq is illegal under international law and U.S. treaty because wars of aggression are specifically prohibited by the U.N. charter, to which the U.S. is a treaty signatory. No court has ruled on this matter, however, because the U.S. is the 800 lb gorilla loose in the world's living room.

The United Nations Secretary-General Kofi Annan has told the BBC the US-led invasion of Iraq was an illegal act that contravened the UN charter.

He said the decision to take action in Iraq should have been made by the Security Council, not unilaterally.

The UK government responded by saying the attorney-general made the "legal basis... clear at the time".

4. Illegal, by all three of your criteria
Its illegal as established by the Nuremberg Trials of major Nazi war criminals. We executed Nazi Generals (like Jodl) or sentenced them to long prison terms (like Donitz) for waging aggressive warfare. So the invasion is illegal, and under international law, is a war crime. The International Criminal Court is currently considering a case of aggressive warfare against the British for their role in the invasion.

Its illegal under the Constitution, because the Congress must declare war, not the President. Also, the President has failed to follow the terms of the War Powers Act of 1973.

Its illegal in my opinion because its an immoral war run for the benefit of war profiteers and psychotic neo-cons.

Its probably also illegal for all kinds of other reasons.

5. Might makes right. Always has, always will
International law is only as good as what it can enforce. There is no "international" military, other than the US military, so if we do something, there is nothing to stop us except overextending ourselves. Nobody listens to the UN, unless there is a real threat of military or economic force(and economic force never hurts anyone with political or financial power). If the US is doing the military force, the UN has nothing to stand on.

Is it legal? Is it illegal? It's legal until something stop you I guess. Well, no, it's not really a question of legal or illegal. It's stop us if you can, one way or another.
