Jury On Eighth Day Of Deliberations

MIAMI -- The jury in the trial of the so-called "Liberty City Seven" has begun its eighth day of deliberations.

Twice the jury has sent notes saying they were unable to decide the fate of the seven men who are accused of plotting to blow up the Sears Tower in Chicago and bomb FBI buildings in Miami and elsewhere, Local 10's Rad Berky reported.

Judge Joan Lenard on Monday read the jury what is called the "Allen Charge," urging the members to think about their arguments. If they are unable to reach a verdict, Lenard told them, "The case will be left open and may have to be tried again."


The seven men charged were all caught on FBI surveillance video pledging support to al-Qaida, but the man leading the pledge was an FBI informant. The defense claims the men were just hoping to get money from the informant and had no intention of going ahead with the alleged plot.

They face up to 70 years in prison if convicted of four terror-related conspiracy charges.

Why aren't they on trial? They've been caught on tape.

3. Raw Story excerpt alleging a cover-up
Rameau said the Liberty City Seven coverage has upstaged other important news. In a conversation with RAW STORY earlier this week, he said that on the day of the Liberty City arrests, “a former director of the right-wing Cuban American National Foundation (CANF) admitted to planning terrorist acts against Cuba.”

Yet this “failed either to draw national attention or merit ‘above the fold’ coverage on the front page of the Miami Herald,” said Rameau.

The CANF conspirators were charged and acquitted by a Puerto Rican jury in 1997, after a federal judge threw out one of the defendants' self-incriminating statements. No charges have ever been brought against the individuals on the U.S. mainland.

A homegrown terrorism case that allegedly sprouted in one of Miami's poorest neighborhoods wilted on Thursday when a judge declared a mistrial in the prosecution of six of seven defendants.

Federal jurors acquitted one defendant in the so-called Liberty City 7 trial, but they could not agree on any of the terrorism conspiracy counts against the others.

''We believe that no further progress can be made,'' the 12-member jury told U.S. District Judge Joan Lenard, ending deliberations after nine days following a two-month trial in Miami. Each, if convicted, would have faced up to 70 years in prison.

The judge ordered a retrial to begin Jan. 7 and issued a gag order.
