Concord – The New Hampshire House today voted to repeal the state’s law requiring that a parent be notified before a minor daughter can have an abortion.
The House voted 226-130 to repeal the 2003 law, which has been appealed as far as the U.S. Supreme Court. The courts ruled the law is flawed because it was unclear how the Legislature intended to protect the health of a girl in an emergency.
The bill, HB 184, moves to over the state Senate next, where it is expected to pass. Gov. John Lynch has said he favors the repeal.
After the vote was announced, a long line of Republicans who fought the repeal lined up to voice formal protests of the action.
The House beat back two attempts to amend the law that notification supporters brought to address concerns the Supreme Court expressed. It voted 213-135 to kill an attempt by Rep. Fran Wendelboe, R-New Hampton, to add court-tested language on health exceptions, and 222-129 on a similar proposal by Rep. Neal Kurk, R-Weare, that had been through a public hearing.
The law -- which has never gone into effect -- requires health care clinics or doctors to notify at least one parent 48 hours before providing a minor girl with an abortion. The law allows girls to go to court if they don’t want to confront their parents.
Those who favored the repeal said the state could not amend its way out of the problem that three federal courts have found. They said a fresh start with a new bill is the only way to find a way to protect parental rights and the health of pregnant girls.
