" allegations of prosecutorial misconduct in the case, reports the Washington Post.

It was because of this misconduct that Attorney General Eric Holder last week decided to ask the judge, Emmet Sullivan, drop the charges against Stevens.

2. I had the same initial reaction, but when I heard more about it I changed my mind.
Not that I think Stevens shouldn't be punished, trust me. But if the case was botched, well, that's the legal system we have. Sort of like if you're arrested but not read your rights, etc. If the system always makes sense is another issue!

At any rate, let's hope this incredibly fair decision (something we would NEVER have seen out of the Bush Administration WRT a Dem) will pave the way for holder to do the same for Don Siegelman.

5. bush doj
If anything this action stands as a condemnation and exposes the serious corruption of the bushista DOJ. IMO it's a testament to the willful neglect and disrespect for the rule of law fostered by the overall attitude of the bushistas and their willingness to ignore established legal procedure and precedent. It's also a statement of the present adminitration's desire to return to a competent DOJ that does what it's supposed to do in the way it's supposed to do so.The real injustice here would be if Stevens gets the charges against him dropped and there's no similar action in the Siegelman case.
