One wonders if this might not be one of the reasons John Brennan and the Republicans are so adamant about not releasing the torture memos. They're evidence:

It is hard to predict what will happen next, but, if arrest warrants are issued, the Obama Administration may be forced either to extradite the former officials or to start its own investigation. Sands, who admires Obama, said, “I regret that I have added to his in-box when he has so much else to sort out. But I hope he does the right thing. There’s not much dispute anymore: torture happened, and the law is clear—torture must be punished.”

2. That puts Obama between a rock and a hard place.
If he releases the memos it will bring down the full force of the right wing against him...and that means the corporate leaders and financial people as well as politicians and the leftovers from the bush administration in the justice department and other agencies.
And they can fuck up a bunch of things.
If he don't release the memos the left will turn on him.
Now we will see just how clever this man is.

4. They have the power to do more than just criticize him
They can take action...like open up the faucet and let the leaks begin or sabotage his efforts.
The real truth is that they still have power and are experienced in using it.

5. I believe the main conundrum here is Democrats are also culpable
Remember these "enhanced interrogation techniques" were brought before Congressional committees that Democrats were a part of and they were signed off on by those same committees.
