Iowa gay-marriage opponents hold soggy rally

DES MOINES, Iowa - About 300 people endured rain and wind outside the Statehouse to show their opposition to gay marriage.

Republican candidate for governor Bob Vander Plaats told the crowd at a rally Monday morning that Gov. Chet Culver should sign an executive order that prevents same-sex marriage in Iowa until the matter can be put to voters.

Same-sex couples will be able to get married within weeks because of an April 3 Iowa Supreme Court ruling that the state's law banning gay marriage is unconstitutional.

Culver spokesman Phil Roeder says governors don't have the power to block a Supreme Court decision. Roeder criticized Vander Plaats for giving the public the impression that Culver could overrule the court.

3. They will just never get the fact
that it is the function of the court to determine what is constitutional. That's not being "activist," it's what they are supposed to do "The will of the people" doesn't mean anything if it's unconstitutional. Neither does an executive order.

The only way around this from their standpoint is to amend the Iowa Constitution. That won't be raised this year in the Legislature, and may not be next year since the Democrats are in control. Even if it is, it needs to be passed by two consecutive Legislatures. The issue of a Constitutional convention will be on the ballot in November 2010, but I doubt that will pass.
