1. Love it
I always love how these 'real constitutional scholars' cite and use the Constitution the way they use the Bible. They take on themselves the sole right to interpret what the Constitution/Bible means and selectively chose to cite only those parts that they interpret to back up their positions. The part of the constitution that the conservatives hate is the part that sets up the federal judiciary and gives them the right to be the arbiters of what the constitution says and means. So when push comes to shove they just ignore all judicial precedents and claim to know the 'original intent' and demand that we live by this doctrine. What is 'original intent' whatever they damn well say it is and don't question them because they are always right.

2. Now that we're in charge, they're back to states' rights, using the defunct 10th Amendmendment
as their crutch. In the last 50 years, how many times has any legislation been overturned by a court's reliance on the 10th Amendment?

4. Federal law trumps State law.
I'm not sure how the Supremacy Clause could be any clearer.

The 10th amendment was how the writers of the Bill of Rights covered their butts. "Yes, we know this isn't a complete list of the rights you have. Just because it's not listed here doesn't mean you don't have that right. Individual results may vary, see store for details."

That line in Article I has rendered the 10th Amendment meaningless.
