Man Who's Not Dad Fights Child Support
State Acknowledges Man Is Not Father, Still Demands Payments

A local man is fighting against having to make back child support payments for a child that is not his.

Brian Stancheski, of Sanford, proved that a 3-year-old boy is not his in order to be able to stop paying child support several months ago, but the state still wants him to pay $9,000 in back payments.

Stancheski's attorney, Max Smith, has fought for his client to be free of the financial burden.

"They never listened to my client when he said he wasn't the father," Smith said.

Smith thought he and his client had a big victory months ago when long-standing child support payments finally ended.

2. Something similar happened to me
years after divorce my X and new hubby adopted the kids and I was not supposed to be paying child support anymore. But she never gave child support the paperwork, I couldn't get it, and they would not believe me.

I ended up overpaying a couple grand and was told if I wanted back I would have to sue her, and she didn't have any money.

Men in every state are abused by a system that is callous and indifferent to their side of the story, a few of our employees have had wages garnished to pay child support even though their ex-wives were estranged from the supported children. One was paying support even though the child was living with him and the other was paying support even though his ex-wifes criminal boyfriend had thrown the teenaged child out of the home.

The great state of California didn't give a fuck because they have dicks, one went to court and lost because the mother lied about providing financial support to her son and the other only was able to cease support when the mother was thrown in prison, prior to mommy being thrown in jail he was nearly arrested for abduction.

4. At some point
the courts have got to take judicial notice of the existence of DNA testing. The paternity laws were developed in a time when one could not be absolutely certain of who might be a child's biological father, we've long since left that time.

Someday, some clever attorney is going to get a supreme court of a state to consider the fact that justice has been done for people convicted of crimes who are exonerated by DNA, and extend that to men who have been unfairly tricked into paying for another man's child.
