Supreme Court Justice Stephen Breyer...and his underwear

all i can say is... lol.

Yesterday the Supreme Court heard arguments about the circumstances in which it is constitutional for public school officials to strip-search a 13-year-old girl. The Court considered some vexing Fourth Amendment issues: Does the nature of the contraband they're looking for matter? What about the credibility of the tipster? Must the officials have specific reason to believe the contraband—in this case, ibuprofen—is hidden in the girl's underwear? But perhaps the most puzzling question raised during the oral arguments in Safford United School District v. Redding was this: What the hell went on at Justice Stephen Breyer's elementary school?

That mystery arose when Breyer was questioning Adam Wolf, the lawyer representing Savana Redding, the girl who was searched. Breyer suggested that Safford Middle School's assistant principal, Kerry Wilson, was not "totally out to lunch" in thinking Redding might be hiding the ibuprofen pills in her crotch or cleavage:

"It seems to me like a logical thing when an adolescent child has some pills or something, they know people are looking for them, they will stick them in their underwear....

In my experience when I was 8 or 10 or 12 years old, you know, we did take our clothes off once a day, we changed for gym, OK? And in my experience, too, people did sometimes stick things in my underwear."

At this point, laughter prompted Breyer to quickly add:

"Or not my underwear. Whatever. Whatever. I was the one who did it? I don't know. I mean, I don't think it's beyond human experience, not beyond human experience."

1. A person has the right to be secure in their person...not their various cleavages and invaginations
I am so sorry that I live in these times.

Life in 1789 was so much more straight forward.

women wore such extensive and all encompassing undergarments, it probably would have taken a patriot act enhanced search to even get the frigging things off.

This reminds me of a situation I was in, years ago. Returning by sea from jr. year in Europe, asked by customs Have you ever been to Cuba? Well, it was the morning after, that is, awake all night aboard ship, didn't exactly know who or where I was; I'd never been to Cuba, my folks had been, on vacation, BEFORE the revolution, so I think that stuck in my head. I hesitated as I tried to answer! And had nightmares about it that night! Will they come after me????

Breyer may have been remembering one of those OLD OLD stories!

9. I feel so left out
They never asked me if I'd been to Cuba (and I have).

I had been invited by their government, and it was in the Reagan years, so the questions would have
been long and tedious, even if the answers would have bored the hell out of any potential interrogators.

Breyer once complimented me on a speech I made in front of a bunch of interesting people, not the least of
which was Justice Breyer. Getting a compliment like that from HIM made him my favorite (OK, he was already that)
Justice on the court.

As for Breyer, yes, I've met him quite a few times.

The first time was Gridiron, 1995. He introduced himself as just "Steve Breyer." I
thought he was joking, but he wasn't. I just said, "yes, I know who you are, Mr. Justice."

After that, I started attending (still do) a 4 day thing at New Year's in South Carolina
that he sometimes attends, and have attended several of his lectures, chatted with him
briefly a few times. On Jan. 1, before we all disperse back to the real world, some of us
are called on to give a parting speech. I was given the honor a few years back of
addressing the crowd for this. It is very intimidating, as the audience is full of
people of Breyer's stature, with a few token mortals like me thrown in for variety. I gave
a speech on what it was like to have almost died the year before, and the new perspectives
it had given me. He came up to me afterwards and told me what a good speech he thought it
was. I was, needless to say, VERY flattered, and a little in awe (I did manage to thank him,
though!).
