A Souter surprise?
Just now on NPR, Dahlia Lithwick who covers SCOTUS for Slate Magazine said that DC is whispering about the fact that Justice David Souter has not hired a clerk yet for this session. Has anyone here heard buzz about a possible retirement?

2. I wouldn't be surprised. And, I think this is where the Specter deal will
pay off. Specter is on the Judiciary Committee that will get a Supreme Court nominee out of committee, and will be needed to end a possible filibuster on a nominee.

10. Not a real problem...
It's just that I'd like to see an entirely new panel. I know that's not going to happen, but that would be my goal.
