Who's in the right here, commenters?

In the past two days, a video of a San Francisco police officer arresting a skateboarder named Zach Stow has gone viral, prompting an online controversy: Did Stow deserve to be handcuffed and arrested, and was the arresting officer out of line when he threatened to break Stow's arm "like a twig" if he resisted?

The video begins with an exchange between Stow and his friends and the officer, who later identifies himself as "Officer Schwab, (badge number) 2099." The police roster shows him to be Officer Noel Schwab, who works at Southern station.

It's clear that it's not a friendly situation to begin with, as Schwab is examining several pieces of identification belonging to Stow's dour-looking friends. Exactly when and where the incident is happening are not known.

The situation goes quickly downhill when Stow explains he is "pissed" because the officer is a "f-- d--." Schwab pulls him up, tells him he is being arrested for "skateboarding in the city and county of San Francisco," and puts him in handcuffs.

I've met much better AND much worse. Don't know much about the guys at Southern Station.

13. The cop actually set up the whole "now I'm gonna act like a dick thing"
The kid was sitting there quietly letting the cop do his thing, protecting the city from middle class kids while crackheads run rampant, and the cop started it all with the "your boy has a headache...... aren't you ashamed of yourself" thing.

3. The cop is a dick, and I believe a liar. It's hard to imagine that skating is illegal in SF
And even if it were, it's clear that his actions have nothing to do with enforcing the law, they are him being an asshole because the kid called him an asshole.

Officer Scwab should get a reduction in his very generous salary, sufficient that he understands that his job is not to be an asshole.

7. It's illegal in most of SF.
They used the gentrification building/zoning push during the developer-friendly Willie Brown / dot.com days to restrict skateboarding greatly in most of the city. Here's an article on some of the most recent restrictions:

4. The cop was being a jerk before the kid called him a dick -- under his breath.
Had the cop simply informed the kids of the statute against skateboarding on public property, the kids seemed polite enough to move along to another area. Instead, the cop took a condescending, bullying attitude with his "does anyone have an Exedrin because your boy looks like he has a headache" comment, which overwhelmed the kid's sense of dignity & moved him to utter "he's a dick" under his breath. Too bad the cop had good hearing.

Another cop-on-a-power-trip story. It was an event that could have been preventable, had the cop been more mature & less macho-minded.

Had the kid kept his mouth shut he'd have been cut loose W/ a warning. You can't control the cops but you can sure as hell not do anything to make it worse on you.

Maybe we ought to treat resisting arrest like they once treated rape. If the cop has no bruises, wounds, or scars then he gets laughed out of the court room.

Sometimes, it takes a lot of fortitude to DIFFUSSE a situation, rather than insist on "being right"...

I think the reason that you've been getting a lot of heat here is that your comment had no context.

Assuming that you do know Schwab is gay, do you expect him to act better because he needs to contribute to a positive image of gays, or because he should be more mindful of how prejudicial behavior by cops kept gays (and women and persons of color) out of the ranks of LE for so long?

The "It's us against them." mentality central to police identity and culture is a very powerful thing. While police departments resisted diversity, ultimately they managed to assimilate the other while maintaining the culture of entitlement due to the perception of risk and sacrifice.

A cowboy was pulled over by a state trooper for speeding. The trooper started to lecture the cowboy about his speeding, and in general, began to throw his weight around to try to make the cowboy feel uncomfortable.

Finally, the trooper got around to writing out the ticket. As he was doing that, he kept swatting at some flies that were buzzing around his head. The cowboy said, "Having some problem with circle flies there, are ya?"

The trooper stopped writing the ticket and said, "Well, yeah, if that's what they are. I never heard of circle flies."

So the cowboy says, "Well, circle flies are common on ranches. See, they're called circle flies because they're almost always found circling around the back end of a horse."

The trooper says, "Oh," and goes back to writing the ticket. Then after a minute, he stops and asks, "Are you trying to call me a horse's ass?"

The cowboy says, "Oh no, trooper. I have too much respect for law enforcement to even think about calling you a horse's ass."

The trooper says, "Well that's a good thing," and goes back to writing the ticket.



After a long pause, the cowboy says, "Hard to fool them flies, though."

45.  He lost his temper. He just didn't pitch a fit.
He apparently wasn't going to arrest anyone based on the activities of the boys when he arrived on the scene relative to the alleged complaint.
He decided to arrest Zach Stowe and hassle the others because he didn't like the way he was spoken to by Zach and the bystanders. That's getting pissy, and it is indeed losing his temper, especially when he threatens to do something that is illegal.

Granted, the kid was utterly a dumb shit for calling the officer a "fucking dick." You don't have to be a genius to know what's going to happen next. That said, this is an easy collar for the cop. It's not some lunatic with an Uzi, or a drunk with a Bowie knife, or a 6'5" man on PCP. So why all the grandstanding and threatening with some little whelp of a skateboarder?

If the cop wants to take the kid in, fine, but he could have made the arrest firmly, quickly and quietly, to greater effect. To the bystanders, he could have just given his name and badge number, said he was enforcing the law, and not engaged them any further.

The cop was going to let them go and he called him names and got him and all his friends in the trouble they rightly deserved.

Seems like shit head wanted to cause a scene so his friend could video tape it and they would be cool. Now that the cop didn't do anything they are still whining like little girls. I hope they try to complain and the video gets them laughed out of court.

Anyone with half a functioning brain cell can tell you what's gonna happen if you call a cop a "fucking dick."

That said, this cop is a real piece of work. He made a fish-in-a-barrel collar (not the kind he'd have to make in the Tenderloin), and yet makes a big tough-cowboy show about it. Real tough guy. His job is to protect and serve the citizenry, but strong-arming a mouth-off skateboarder and grandstanding are out of bounds, IMO.

70. Calling a cop an asshole is not a crime
When in uniform, cops are an extension of the government, not people, and should shrug off personal verbal attacks, period. It sucks, yes, and most cops cannot separate their personal feelings from their professional requirements.

Call someone at the DMV or the IRS a fucking dick and see where it gets you. Hell, I've had people be extremely rude to me at my job and they did not get class A service afterwards.
