5. Changed their minds? Are you sure there are 14 total on that court?
Usually its an odd number so there would never be a tie.

Calling the delay "unnecessary and unreasonable," Lautenberg said on the Senate floor shortly before the vote, "Justice has been delayed while those who refused to let this vote take place had another agenda to score political points."
