Bottom line: Torture is a crime and advocating it is not covered by freedom of speech.

The same way telling someone to go and rob a drug store is not free speech.

The federal government would be way within constitutional rights to shut down radio stations
that advocated torture. And if they did, that wouldn't be anything I would lose a night of sleep over.

1. You can advocate for the legalization of armed robbery.

And you can advocate for the legalization of torture. Free speech doesn't include conspiracy to commit crimes, your speech in those cases is part of the crime itself. Laws against inciting others to abstractly commit crimes are violations, in my opinion, of our right to free speech.
