California's new attorney general 'will not defend Proposition 8'

During Kamala Harris' victory party last night at the Delancey Streey Foundation in South Beach, where she celebrated a narrow win against Los Angeles County District Attorney Steve Cooley in the Attorney General's race, she promised some sort of surprise. That apparent surprise, at least for Californians outside the Bay Area, was the announcement that she will not defend Proposition 8, the same-sex marriage ban.

When the San Francisco District Attorney joins her entourage of democrats to Sacramento next year, she said she "will not defend Proposition 8."

2. does this mean that one person can bring up an appeal
and the state will decline to persue the defense of prop 8 and that with that one case gay marriage will be legal again??? this is great!

3. now if she would agree to stop prosecuting
cultivation, sales, and possession of cannabis..... but i am happy for all my gay brothers and sisters in california!!! your equality will again respected in a state with one fifth of the us population

6. This is what's already happening.
A gay couple challenged the law. Caifornia declined to defend. The hold-up has been the appeals court allowing people with no standing to argue that they in fact do have or should have standing. The haters, excuse me, the groups trying to get standing have to show that they will be harmed if the law is overturned. They haven't (afaik). Overly-simplified, but that's the meat of it.
