Ex-Harper adviser should be charged: Assange

"WikiLeaks founder Julian Assange says a former adviser to Prime Minister Stephen Harper should face criminal charges for suggesting that the Australian whistleblower should be killed.

During an online interview with London's Guardian newspaper, Assange commented on Tom Flanagan's recent suggestion that he "should be assassinated" for his role in the public release of U.S. diplomatic cables.

"It is correct that Mr. Flanagan and the others seriously making these statements should be charged with incitement to murder," Assange told the Guardian website on Friday.

Flanagan, who previously served as Harper's chief of staff, has already apologized for the controversial remarks he made earlier this week while appearing on a political talk show."

As it does not appear to contractict the second clause in Human Rights Act of 2000, Article 10 Freedom of expression.

Article 10: Freedom of Expression

(1) Everyone has the right of freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without inference by public authority and regardless of frontiers. This Article shall not prevent States from requiring the licensing of broadcasting, television or cinema enterprises.

(2) The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary.

Insighting murder should not be included under freedom of expression.

4. Quite a few people are writing and emailing the U of C asking he

be disciplined. If our legal system is too spineless to charge him with inciting violence, hopefully he'll at least be reprimanded at the University ..... or better yet, fired. He's a disgrace ....... if calling for murder makes him feel manly ...... well, he shouldn't be anywhere near students.
