1. Try reading the text

(b) Whenever the loss of United States nationality is put in issue in any action or proceeding commenced on or after September 26, 1961 under, or by virtue of, the provisions of this chapter or any other Act, the burden shall be upon the person or party claiming that such loss occurred, to establish such claim by a preponderance of the evidence. Any person who commits or performs, or who has committed or performed, any act of expatriation under the provisions of this chapter or any other Act shall be presumed to have done so voluntarily, but such presumption may be rebutted upon a showing, by a preponderance of the evidence, that the act or acts committed or performed were not done voluntarily.

Therein lies the problem with having no trial.

3. Snap!
I'm glad there are smart and decent people around here who don't look for reasons to justify murder.

Welcome to DU! :hi:

2. Killing people is wrong. Simple truth. Violence begets violence.
Does anybody else remember the time period where they first heard the phrase "capture or kill" used by our government? It creeped me out then. It creeps me out now.

6. Thank God for souls like you.
Can you imagine a world of nothing but people like those GOP debate audiences and other proponents of death? I guess there's only a handful of us left standing between cherishing life and barbarity

Welcome! Glad you are here! :hi:

16. To renounce US citizenship requires paperwork and an oath taken before a US Consular official
http://travel.state.gov/law/citizenship/citizenship_776.html

They make it very difficult deliberately. You can't renounce US citizenship by saying "Oh bugger the USA!", by living out of the country for a certain number of years, nor even by taking an oath of citizenship someplace else. You have to jump through hoops and in do it in person in a US Consulate or Embassy. Lots of expat Americans have been living abroad for years before they find out how the full renunciation thing really works - and then they have an unexpected expense waiting in store for them. This way, the IRS retains dibs on your income even though you have become a citizen of a foreign country, and have been living over there for decades and haven't been back to the US once the whole time.

9. Right. Extrajudicial execution
has become a normal part of US foreign policy. When does it become a part of US domestic policy?

7. Trials aren't just for citizens, one would think that there would be absolutely no argument
that the protections in the constitution do not apply to us.

You should also understand that nothing in the reference law is applicable in this scenario.

8. So that gives you the right to kill someone
without a trial?

Nationalism of your kind is criminal. Go to Free Republic if you want to post such BS.

the Enemy and With Intent to Kill Americans-He Knew what he was doing, he understood the risks and consequence of his actions, he Denounced "Being American" when he joined with the Enemy.
How would You feel AFTER he carried through a plan that hurt, maimed or killed your family and friends via Premeditated Plans and Intent?

I stand with the President on this one.

14. It appears you are completely fine with no indictment or judicial review
It must be asked of all of you that cheer this killing why if this man was obviously a threat was there no indictment leveled against him by our government? It would seem that if the case was such a slam dunk it would have taken only a few minutes over the last year to obtain at least a shred of judicial review of this killing.

If you cannot answer that question, you are basically cheering for an imperial Presidency and for the abandonment of the rule of law by this nation.

19. My opinion of this issue does Not
paint an overall broad stroke for All matters.
I stand by my observations, available knowledge of this man and the risks he posed for America and her people. I considered and weighed the Harm V Benefit.
I don't Like the fact that this was even necessary, but our individual opinions don't change the ugly facts and it is fact we must respond to. At times and as uncomfortable as it is we must drop our ideology and emotions to deal with the ugly facts/truths out there.
I stand with Pres Obama. Al-Awalki denounced all things American, "being" an American in Favor of Destroying America, you, I, our kids, friends and families.
He was a most dangerous individual. Period.

12. To me that does not matter
I don't subscribe to the notion that the citizenship makes a huge difference, as if only US citizens should be treated fairly. If it was wrong to do to Awliaki, it's wrong to do to any noncitizen.

At 18 he needed to decide where he was a citizen. Seems to me he hates the US.

15. Is hating the United States your threshold for abandoning the rule of law and murdering folks?
What about speech? Is there a list of words that you feel warrant summary execution if uttered by anyone anywhere on the planet?

18. No, but the citizenship laws are that if you have dual
citizenship, when you turn 18 you pick one.

The US does not enforce that very well, as Awlaki was apparently allowed to enter the US as a citizen.

But he could have chosen at 18 and I doubt he'd have chosen ours. Though maybe he maintained it to be able to have the advantage of entering without a visa. A member of AQ is not going to be granted a visa to visit! So he took advantage of his birth and time here. His ability to speak American English easily made him an advantage to AQ.

But my point is that you are granting magical superiority to Americans. They have right to trial and non citizens don't. Well if that's the case, if an illegal alien is accused of a crime, he does not deserve a trial according to your theory.
