Retroactive Recusal could wipe out Citizen's United!!!???!!!
Representative Slaughter was discussing this with Keith in the last few moments of his show!

3. Slaughter said the vote was 5 to 4
if a judge is forced to recuse - either Scalia or Thomas, it would go down.

6. "Forced" by whom?
There's no enforcement mechanism in the law. The final word on whether or not a USSC justice recuses him/herself is... that justice.

7. this is over Thomas' wife's political work, and his conflict of interest
they are looking into the cases he was in on, but had obvious conflicts.

You can't force a USSC judge to retroactively recuse himself from a case.

Congress could impeach him, but that's obviously not going to happen.

Who is the "they" who are going to get this done?

Also, there doesn't appear to be any "there" there. He failed to properly file disclosures, but that didn't hide his wife's political activities (that were common knowledge), so there isn't anyone (who argued a case before him) who could claim that it was hidden from them. His political activities "smell", but all you can do is shed light on them (which is really what this ongoing "recusal" story is all about. They can't imagine that it would go anywhere except to make him look bad.

15. the only scenario i can think of is a bargain -- he recuses himself in exchange
for not getting impeached.

of course, this would only work if impeachment were a viable threat, which it is not, at least not unless some rather more damning evidence surfaces.
