Obama Administration Says Miranda Warning Doesn’t Count for Terror Suspects


In a move that likely will please conservatives, the Obama administration is moving ahead with its plan to expand the government’s power to hold terrorism suspects longer without issuing a Miranda warning.

Law enforcement is required to immediately read a criminal suspect his or her Miranda rights—to remain silent and have an attorney present during questioning. However, a 1984 Supreme Court decision created an exception to the 1966 Miranda ruling that allows law enforcement to delay reading someone their Miranda rights if there is a public safety concern involved—and testimony taken during this period is still admissible in court.

Critics on the right admonished the Obama administration after recent high-profile terrorism incidents involving the Christmas Day 2009 bomber, Umar Farouk Abdulmutallab, and the Times Square bombing suspect, Faisal Shahzad. Both were questioned for a period of time before they were read their Miranda rights, which alarmed civil libertarians. Reportedly, Abdulmutallab was questioned for three hours before being read his rights and Shahzad for 50 minutes. Many conservatives felt Miranda should never have been a factor at all for the two suspects.

Attorney General Eric Holder Jr. believes the Justice Department has the authority to alter Miranda procedures without approval from Congress. Some lawmakers disagree, fearing any change that doesn’t have legislative backing will have a tougher time surviving a legal challenge in federal court.

9. AND, It's Becoming MORE Than Simply Disgusting! I'm so SICK Of Trying To Tell
that I feel I'm going to HAVE to vote for Obama again! MANY, MANY Democrats are so disillusioned and it just keeps coming!

Just returned from picking up my monthly "Angel Food Ministries" food package and kinda/sorta/ got into an argument with a NITWIT who was talking about, OF ALL THINGS how Obama is a MUSLIM thingey and I HAD to defend him. Given that I live in Florida and in a Ruby Red District, all EYES were on me. Earlier in the conversation several of us people were talking about the Education cuts here in Florida and talking about how kids, computers and their lack of spelling acumen. So THIS guy says he wouldn't OWN a PC, to which another piped in and said you "practically have" to own one these days. But he remained stubborn!

But here's the REAL kicker... when it came to the MUSLIM thing, birdbrain said he KNEW for a FACT that Obama WAS NOT born here and that HE IS a Muslim! Know why?? He said he has an UNCLE who REALLY has the TRUE facts because he is a Senator. Want to know the name of his uncle?? Alphonse D'Amato!! Luckily I DO happen to KNOW about Al from New York, so I said "well, if Alphonse is your uncle then tell me WHY he got indicted for a crime and then LOST his next election?" I'm not actually sure what his crime was but I do recall there was something regarding money. But then I said to him that all he had to do was GOOGLE the PC and he could find a copy of the BIRTH CERTIFICATE, but then I said "oh, I forgot you don't OWN one" so how would you be able SEE it for yourself??

I swear this guy looked like he just came in from sleeping under a bridge with his uncombed hair, and torn shirt. I really wanted to ask him why good ole AL didn't send him some moolah so he wouldn't have to be picking up monthly groceries at a discount! We didn't say anything else to each other, but all eyes were on me because I KNOW at least HALF, if not more there actually DO think Obama is a foreigner! This is ONE thing I will defend him on, and even though I KNEW about D'Amato many felt I was totally out of line!

But in "some" ways Obama IS bit of a foreigner... to many of us Democrats! He's done so many things that seem rather foreign to my way of thinking as to what a Democrat is to me.

Sorry for the rant, but I'm still fuming about the idiots around here, and it's pervasive thinking where I live and makes me want to...

10. I don't blame you for the rant - it's hard NOT to have one these days...
I think it's just fear and ignorance that keeps people clinging to crazy ideas - the world seems very scary to those who get their "news" from sociopaths like Beckkk.

Know what ya mean about Obama not really being a "foreigner" but seeming that way when it comes to Dem principles - I really wish a strong fearless populist would primary him.

2. Oh, I can overlook little things like this.....
...because certain people keep posting a long list of things that Obama "pledged to" do, and some other things that he "committed to" and a bunch of things that he gave a speech in which he said he "supported". And apparently that's supposed to be enough to keep me happy and cheering and not pissed off at the things he actually "does" and the people he directly and personally "appoints".

13. Let's see here, Obama affirms the "right" for the president to declare anybody,
Foreign or domestic an "enemy combatant". He endorses warrantless wiretaps. He doesn't close Gitmo. He endorses indefinite detention. Now he waves Miranda rights for "terror suspects"

Anybody else who is active in anti-war, or other such activism feeling the noose starting to tighten?

Anybody else wondering what happened to "change"?

Absolutely despicable.

...is anyone who is speaking out against the U.S. government. The government
can do anything to anyone who is classified in such a manner--including treat
them like a "terrorist".

So, technically anyone who dares to speak out, protest or post non-sparkly-rainbowy
comments about any US policy--is without Miranda rights.

The Obama Administration is announcing that they will reinforce and continue the horrid,
Fascist, nightmare-inducing legacy of policies that the Bush clan initiated.

That is all. Now back to Dancing With the Stars.
