Passenger seat wannabe-lawyer freaks out at Texas border patrol checkpoint and gets them both arrested.
The video is about seven minutes long, and it's a lesson in how not to behave at a border checkpoint. All this yahoo had to do was answer one question (are you a citizen) and they would be on their way. But no, he had to be an asshole about it.
What is ironic, is he is exactly the type to complain about lax border policies and "OPEN BORDERS!!11!!". You know he has complained about open borders, you just know he has.

I think I spotted the checkpoint based on the other checkpoints in South Texas. Looks like they were coming from Eagle Pass. (Eagle Pass is not a tourist crossing). MAGATS are going to Eagle Pass to "watch the border".
Tourists (shoppers, fun seekers) go to Laredo and the lower Rio Grande Valley (Brownsville, McCallen etc)

Those questions are improper but they do it anyway.
Once, as a rookie lawyer hell bent on asserting the Bill of Rights, at a checkpoint on a north/south highway, and after verifying my citizenship, I replied south to the first and north to the second. The assholes ordered me into secondary and searched my vehicle. I told off the supervisor and drove away 45 minutes later.

No hassles we simply said we were going to/from Big Bend or to White Sands or back to El Paso.

They rounded up five of my "dark skinned students" at the Bashas in Sells to interrogate them for having latino last name. I saw this and yelled out to one of my students "hey (name redacted), tell everyone we still have our test on Friday on WW2." The BP officer looked over at me, shot me a very angry glare, and let them go.
They drive like maniacs on the roads, ignoring speed limits and tribal laws. And act like an invading army on sovereign tribal land.

These folks are the people who are working to secure said border, so if these fucksticks are the great americans they fancy themselves to be, why are they not dutifully doing what was asked of them to make their jobs easier and thanking them for what they are doing?

He's overdoing it for sure. But I do wonder about setting up border checks away from the border. Isn't it a bit like the "stop and frisk" laws in cities?
I crossed the Canadian border near Buffalo numerous times before 9/11. Routine questions about citizenship, place of birth, where from and where going to. But those checks were only right at the border. I don't remember ever seeing citizenship checkpoints anywhere away from the crossing point.
I do remember, though, that when I was much younger and lived in PA, the PA state police occasionally set up checkpoints on highways. Had nothing to do with checking citizenship. They were looking for driving violations, e.g. expired inspection or registration stickers, not having a valid driver's license, being under the influence of alcohol or drugs. Haven't seen a checkpoint like that in decades and don't know of they are still legal.

My passport proves citizenship.
The only other question I'd answer would be "are you bringing anything back?" The other questions would get "5th amendment right to remain silent" answers or snide ones if they started getting aggressive.
One time at Nogales, the guy got in my face and screamed at me "you will tell me where you live." I calmly responded "in about an hour part of my will be living in your wife's pussy." Another screamed "I hate Americans. They always cause problems here." I responded "because we know our rights."
Submitting to authoritarianism "where are your papers" questions is wrong. It's not my requirement to help them with their investigation in anyway. If hey suspect I am illegally here with a thick NYC accent, prove it. Until then, I exercise my 5th amendment right to remain silent and have "that god damned piece of paper" (you know, what W called it) to back me up. It's that paper these green uniform wearing fascists took an oath the protect.

One liter of alcohol and one case of beer may be imported per person every 30 days.
No ID=no liquor. You must prove that you are 21 or older. If you show false or altered personal identification, the ID will be confiscated and you will be prosecuted.
If you are 18 or over one carton of cigarettes may be imported.
It is illegal in Texas to consume or possess with intent to consume alcoholic beverages in a public place on Sundays between 2:15 a.m. and noon or on any other day between 2:15 a.m. and 7 a.m.

I know must of this stuff is old school and I doubt CBP seizes a few packets of prescription drugs these days, but large quantities of consumer products with the intent to resell is subject to seizure, unless these products have been declared. My FIL used to purchase meds and hide them. It was always a gamble to purchase cheap meds because they could be seized up return.

Establish citizenship, check for contraband, let me pass. I don't get this in airports. Not even my wife got that with her IR1 when I was with her in Boston.
What is amazing is I live in Western PA Technically, I'm within that 100 miles of a border crap. But I see no border patrol checkpoints. Nor did I when I grew up in Niagara Falls. In fact, I didn't know what border patrol was until I went to U of Arizona.
I never got the invasive questioning crossing Rainbow or Lewiston Bridges back from Canada.
So our border policies are racist and selective AF.

I have been through checkpoints dozens of times.
"Are you a citizen?" I reply "yep" and I'm gone.
Never been hassled, not once.

He had the right to be an *sshole, but no justification for it. He has the right to refuse to answer questions, but they do have the right to ask.
Rights are meant to protect the people from improper government actions. They weren't doing anything improper. The driver had the right attitude. He politely and calmly declined to pull over. That's his right and he showed how easy it is to exercise your rights, if you're so inclined, without trying to escalate the situation.

The man in the video was an asshole, he has probably always been an asshole and will always be an asshole. He was itching for a fight with the BP and had probably rehearsed what he was going to do when he crossed the border. You could tell that his poor brother just wanted to comply with the reasonable inquiry and go on to his job. He was more intimidated by his vocal brother than a bunch of people with guns. There is probably a reason for that.
The asshole probably sees himself as some kind of patriotic hero. He will be wrong, he is just an asshole.

Are immigration officials allowed to stop people in places wholly inside the U.S.?
U.S. Customs and Border Protection, the federal agency tasked with patrolling the U.S. border and areas that function like a border, claims a territorial reach much larger than you might imagine. A federal law says that, without a warrant, CBP can board vehicles and vessels and search for people without immigration documentation "within a reasonable distance from any external boundary of the United States." These "external boundaries" include international land borders but also the entire U.S. coastline.
What is a "reasonable distance"?
The federal government defines a "reasonable distance" as 100 air miles from any external boundary of the U.S. So, combining this federal regulation and the federal law regarding warrantless vehicle searches, CBP claims authority to board a bus or train without a warrant anywhere within this 100-mile zone. Two-thirds of the U.S. population, or about 200 million people, reside within this expanded border region, according to the 2010 census. Most of the 10 largest cities in the U.S., such as New York City, Los Angeles, and Chicago, fall in this region.
Some states, like Florida, lie entirely within this border band so their entire populations are impacted.
Are there limitations to immigration officials' power?
The Fourth Amendment to the U.S. Constitution protects against arbitrary searches and seizures of people and their property, even in this expanded border area. Furthermore, as a general matter, these agents' jurisdiction extends only to immigration violations and federal crimes. And, depending on where you are in this area and how long an agent detains you, agents must have varying levels of suspicion to hold you.
