Judge uses Brett Kavanaugh's own words to shut down Alabama abortion prosecution

A federal judge used the words of conservative Supreme Court Justice Brett Kavanaugh to shoot down an effort to dismiss lawsuits challenging right-wing Alabama prosecutions.

The state’s attorney general has vowed to prosecute anybody helping residents travel elsewhere in the country to seek abortions after Alabama banned them with no exceptions. Pro-reproductive rights group Yellowhammer Fund, along with the ACLU, sued and claimed Attorney General Steve Marshall’s action would be a violation of constitutional rights.

But Marshall, a Republican, filed a motion to dismiss the lawsuits. "An elective abortion performed in Alabama would be a criminal offense; thus, a conspiracy formed in the State to have that same act performed outside the State is illegal," Marshall's office wrote.

This week, U.S. District Judge Myron Thompson denied the motion, reported Newsweek. He used the words written by Kavanaugh in his concurring opinion in the ruling that overturned Roe v. Wade. Thompson wrote that the state, "cannot constitutionally prosecute people for acts taken within the State meant to facilitate lawful out of state conduct, including obtaining an abortion."

As if the SC or the Reich wing even cares about the Constitution. Only the 2nd amendment, which they CONSTANTLY mis-read.

I was mocked for suggesting they will be after contraception.
I was ignored for suggesting they would come after the 19th Amendment. Yet here we are:

In early 2021, when voting restriction laws were being passed all over the country, I said that they would come after women next. Like you said...here we are now.

..up and moved here from Seattle. Ive added a bedroom to my house so the two grands can move back here once they get tired of the personal restrictions. They are 18 and 20. On the other hand Alabama gained 4 new democrats as dtrs hubby is a Scot and got his citizenship last year just so he can vote.

...And grand dtr #1 has already contacted me to help arrange services for one of her (possibly) pregnant friends in Ohio....

When Colorado legalized marijuana, people drove there from nearby illegal weed states to partake. They could not be prosecuted.

People traveled from all over the US to Nevada to gamble because gambling was illegal in their home states. None of them were prosecuted for gambling upon their return home, as I recall.

There are dry counties in the US where people can go out of the county or state to drink alcohol. They are not prosecuted upon their return.

I don't know how cons can support this leave-the-state-for-abortion nonsense with all this other precedent.

I've never heard that Utah, where gambling is illegal, stops their residents on the I-15 at the border to determine if they are going to NV to gamble.

But, states like Alabama and Texas want to restrict their residents from traveling to states where abortion is legal.

These self-righteous bastards can go choke on their own vomit. The sooner, the better.
