We have the first opinion, in Culley v. Marshall.
The court holds that in civil forfeiture cases involving personal property, the due process clause requires a timely forfeiture hearing but does not require a separate preliminary hearing.

The petitioners in the case, whose cars were seized, argued that the Constitution requires a preliminary hearing to determine whether states may retain seized personal property while they wait for the eventual forfeiture hearing. The court holds that the forfeiture hearing has to be timely, but that there is no separate preliminary hearing required.
