Supreme Court lets GOP-drawn Alabama congressional map stay in place

(CNN)The Supreme Court, in a 5-4 decision, allowed a congressional map drawn by Alabama Republicans to remain in place Monday, freezing a lower court ruling that said the map likely violates the Voting Rights Act.

The lower court had ordered a new map to be drawn, which could have led to Democrats gaining another seat in the House in the fall.

Chief Justice John Roberts joined the three liberal justices in dissent.

The justices also said they would hear arguments over the map, adding another potentially explosive issue -- concerning the scope of a key provision of the Voting Rights Act -- to the court's docket.

But basically he promised to take a look at it next term (after the 22 election cycle). He's objection was more around the lower court did their job and followed proper procedure, so the SC shouldn't interfere at this time.

The difference, in NC at least, is that the maps violate the state constitution, so the state Supreme Court ruled on it. The US Supreme Court doesn’t take cases like that, that lack a federal question. These Alabama maps were said to violate the federal voting rights act, so SCOTUS ruled on that.

It isn't a final ruling on the merits. It just kept the district court from messing with the upcoming filing deadline and primaries.


The lower court had ordered a new map to be drawn, which could have led to Democrats gaining another seat in the House in the fall.

It might have... but it could also have been a disaster that resulted in all seven seats going republican. Sewell's district is D+29 under the new maps. The surrounding districts at R+65, R+36, R+34, and R+32. It might be possible to make all of the districts more competitive, including two with substantial POC populations, but have them all go red in November.
