Trump loses bid for mistrial in hush money case

The judge in former President Trump's ongoing hush money criminal trial rejected his request for a mistrial on Tuesday.
The big picture: The request comes the same day adult film actress and star witness Stormy Daniels testified in the case. Trump's legal team alleged Daniels changed her story on the stand from what she said in 2016 when pushing for the mistrial.
"A lot of the testimony this witness talked about today is way different than the story she was peddling in 2016," Trump attorney Todd Blanche said Tuesday. But Judge Juan Merchan, who is presiding over the case, said, "I don't think we're at the point where a mistrial is warranted," per the New York Times.
Catch up quick: In her testimony, Daniels described the night she says she met Trump at his hotel for dinner in 2006.
Daniels testified that she told Trump at the time that he was "arrogant." She recalled asking him about his wife, to which Trump allegedly said that he doesn't sleep in the same room with her. Merchan told prosecutors that "the degree of detail we're going into here is just unnecessary," per CNN. "When [Daniels] comes back to the stand, we can move it along more quickly," the judge said.

That's like if a witness points to a defendant and swears "That's the man that shot me!" then that should not be allowed, the jury might get the idea that the defendant shot the guy. They are saying "she told the truth, and we can't handle having the jury hear the truth!"
I know a lot of it was that she strayed from the charges, but they seem to be more complaining about how what she said might make the jurors not like trump.

(510 posts)OJC's lawyers will use "prejudicing the jury" on appeal, and if the appeal gets to a conservative appeals court, or. Darwin forbid, the Supreme Court, it will be a convenient excuse to overturn any guilty verdict.

Judge says remedy for defense is on cross-examination
"As a threshold matter, Mr. Blanche, I agree that there are some things that would be better left unsaid," Judge Merchan told defense attorney Todd Blanche in denying the defense's motion for a mistrial based on Stormy Daniels' testimony.
"The witness was a little difficult to control. Having said that, I do think there were guardrails in place ... certain details that I don't think we needed to get into," the judge said.
"Whether these are new stories or not new stories, the remedy is on cross-examination. So I'm going to deny your motion for a mistrial at this time," Merchan said.
"I was surprised that there were not more objections" from the defense team, the judge added.
"At one point, the court ... objected, because there was no objection coming from the defense," he said.

Apparently after being goaded by Trump to do anything to stop the brutal and graphic testimony of Stormy Daniels. Trump attorney Todd Blanche has asked for a mistrial. Trump was furiously writing notes and passing them to Blanche during Daniels testimony. So telling the truth and providing evidence of Trumps actions with Daniels is so upsetting and graphic that they should warrant a mistrial? I smell desperation from Trump and his legal team.

(33,196 posts)The only reason he did pay her was that it would have been embarrassing if she had spoken up just before the election. He has incriminated himself convincingly.
We need to remember that it's not about the sex, it's about the election misbehavior. (Reporting the payoffs as legitimate business expenses.)

However, she should have been confined to "yes/no" answers to establish the timeline for the affair and the payoff, I don't see anything else she has to say particularly germane to the case, except whether or not she was allowed to speak out after the election by the terms of the agreement..
Now outside the courthouse is completely different. She can rattle on forever about what a shit he is.
