A federal judge Tuesday indefinitely postponed the criminal classified documents trial of former President Donald Trump, a court filing shows.
The trial on charges that Trump willfully retained classified national security records after leaving the White House and then hid them from federal authorities was scheduled to start May 20. But the new ruling from U.S. District Judge Aileen Cannon vacates that date and sets a new slate of pretrial proceedings, the latest of which is a hearing set for July 22.
The ruling casts more doubt on whether Trump, the presumptive Republican presidential nominee, will face trial on the federal criminal charges prior to the Nov. 5 election. Lawyers for Trump have urged Cannon, whom Trump appointed to the federal bench in southern Florida, to set the trial after the election.
Cannon wrote in Tuesdays court order that it would be imprudent to finalize a trial date at this juncture when various pretrial issues have yet to be resolved. Cannon pointed to pending questions about how classified information will be handled in the high-profile trial of the former president, along with additional pretrial and trial preparations necessary to present this case to a jury.

(280 posts)"Mischaracterization" is a noun that means the act of describing something in an inaccurate or misleading way.
It's probably up to the court to decide if significant or not. You know which way Cannon decided.
The concession from prosecutors in a court filing Friday afternoon came after attorneys for one of Trumps co-defendants asked for a delay in the case because the defense lawyers were having trouble determining precisely where particular documents had come from in the 33 boxes the FBI seized almost two years ago.

So what if Smith can't perfectly align the documents' order. I don't get how one conceded imprecision impugns the accuracy of the overall pre-trial preparation. So what.
It smells like a typical Cannon bias toward looking for further pretext for further trial delay.
Defense needs due process, but this doesn't rise to any level of major prosecutorial error.
This judge is ill equipped to handle any criminal trial of this historical magnitude. Even the 11th Circuit knows The People deserve better. Smith should appeal to the 11th Circuit.

(1,677 posts)They have zero authority to do that. In fact they must abide by all lawful orders...such as court decisions. It's right there in federal court that they must act as officers of the law.
If a court says he goes to jail, then he goes to jail, and up yours to the SS if they don't like it. They'll have to figure out a way to make it work, or someone else will do their jobs for them.

But as things stand today; IMO aint happening. Even if convicted he'll appeal FOREVER. And for this current case, if convicted he wouldnt get jail anyway.
We wont see any of the others make it to court before Election Day.

I think Judge Cannon knows that V.S.P. goose is cooked and the best outcome she can work for
is delaying the trial until after the election. America executed the Rosenbergs for the same type
of actions and FBI Agent Robert Hansen died in the Colorado Fed. Super Max doing 15 life terms
for stealing and selling our secrets to the U.S.S.R. Trump deserves the same fate and if what I
suspect he did is correct* he is in deep shit that even Cannon cant get him out of it.

I also think they will try and steal the election too. I plan to vote Biden and hope the majority do to. The Republicans stopped caring about following the laws, however, along time ago , and if the courts end up refusing to uphold Constitutional law regarding elections, then what?
History is paved with a wide swath of governments and civilizations who thought they were invincible and they weren't. I really think so many people are stubbornly convinced that a dictatorship isn't going to happen here, and that the norms will hold and save the day that no one wants to even consider a plan B if they don't. I feel like we will be sitting ducks, if people don't wake the hell up. I mean even John Stewart is acting like what the hell. Having an old guy is scarier than having a dictator? I mean wtf. I got a few documentaries to recommend to him about what's gone on in just Germany, China, and Russia alone under dictators over the decades.
If it comes down to a Trump dictatorship, or our side having to defend us from him by breaking a few norms along the way too, I prefer they defend us.
