First House Democrat calls on Henry Cuellar to resign

Rep. Dean Phillips (D-Minn.) on Friday became the first House Democrat to call for Rep. Henry Cuellar (D-Texas) to resign over federal conspiracy and bribery charges.
Why it matters: Cuellar is the second sitting member of Congress currently under indictment, along with Sen. Bob Menendez (D-N.J.), who has faced calls for resignation from over half of his Democratic colleagues.
What he's saying: "While the bar for Federal indictment is high, trust in government is at an all-time low," Phillips told Axios in a text message.
"That's why I believe any elected official or candidate facing such charges should resign or end their campaign. That includes Sen. Menendez, Donald Trump, and Rep. Cuellar."
The backdrop: In a 54-page indictment, the Justice Department accused Cuellar of taking nearly $600,000 in bribes from an Azerbaijani government-controlled oil company and a Mexican bank.
In exchange for the bribes, prosecutors allege, Cuellar pushed legislation and pressured government officials to benefit Azerbaijan and the bank. Cuellar has proclaimed his innocence and said he plans to run for reelection in November. He secured the Democratic nomination in March. Representatives for Cuellar did not immediately respond to Axios' request for comment.

(92,605 posts)through a letter, and while it was argued at the time it was Frankens choice, the fact is when you have around 40 Democratic Senators sign a petition urging him to resign, he really didnt have much choice, and was never given due process to present his case before his Senate colleagues due to the pressure for him to resign.

(748 posts)for criminal and civil trials. It does not apply to an ethics committee hearing. And since its a hearing there is no case to present. The committee determines what evidence to consider and what witnesses to hear testimony from.

That is the Connotation I am using it
in this case I am using it as a proceeding to present his case before the ethics committee which he was going to do before the petition and pressure was put on him to resign

(748 posts)He doesnt get to present a case. The most he could have done is testify but only if the committee called him to give testimony. And if the committee didnt feel they needed to hear from him, he wouldnt have been called.
Plus the ethics committee doesnt determine guilt or innocence, only if senate ethics rules were violated. Nor can it kick a member out of the Senate or prevent other Senators from calling for his resignation. It is totally immaterial to his resignation.

And regardless of whatever their findings, it still has no bearing or influence on his resignation.

(748 posts)That's not how congressional committees work. And it wouldn't exonerated him of the accusations. It can only determine if senate ethics rules were violated.

(1,755 posts)Without saying you know nothing about it. For the record, TX-28 is D+3. If a Democrat runs, then a Democrat will likely win. His district is Laredo, and San Antonio's east and south sides, which are predominantly Hispanic and/or black.
Not all of Texas is traitor GQP.

You insult the tens of millions of Democrats living in the blue cities and the border of Texas when you make ignorant assertions like that.

For the record, I was born and raised in Texas, specifically the most Democratic part of the state, and I would never discount Texas democrats fervor.

But everyone is innocent until proven guilty.
I've watched the Menendez case from the point of view of a NJ Democratic Committee member. I did debate prep with First Lady Murphy, and I've now switched my support to Dr. Medina-Campos.
If it is Kim, the GOP Candidate and Menendez - I'm voting for Bob if he is found innocent this month. In the choice between two sleazy politicians - I'm voting for the one that came to our rally in 2018 in defiance of children being separated from their families by the Trump Regime - and who was livid about the Affirmative Action decision by SCOTUS. He will also vote to lift the filibuster for the passage of Voting Rights.
If Cueller is found guilty - by all means - step down. But until found guilty -you are innocent. But I also trust the people of his district and give them the agency to demand he step down.

I trust Cueller's district - I trust the people of my state to make the best decision for their personal interests.
ETA - being a high dollar financial contributor AND an elected Comittee member for your county - stay focused on protecting your county party members. Stay off the "high heat". That's my dad's phrase when he coached our little league team.
High heat is out of focus and takes you off task. Your key job this November is to get those local and county seats. I've been doing this for awhile. I'm going two towns over for a few hours this afternoon to canvass with Council Candidates and Altman volunteers. Its not just my precinct - its getting to know candidates I will be financially supporting and letting them.leverage my profile in the county.

Avoiding Obama?: Texas Rep. Henry Cuellar, a Democrat who hasn't decided how to vote, is refusing to answer a telephone call from the White House.
"If I have to talk to him, I'll talk to him," Cuellar said begrudgingly of a phone call his office received from the White House on Wednesday. But Cuellar told reporters in the Capitol he has so far refused to return the call because he first wants to decide how he'll vote on the health care package.
He also acknowledged that it was "White House staff" that placed the call, but he presumes the president wanted to speak to him. "At the end of the day, when we take a vote, he's not going to be out there supporting me and running my elections," Cuellar said.
"It's going to be up to me to run my election. And it's up to me to decide on my own that this is in the best interests of my district."

Stupak eventually crafted an amendment that 64 (D)s signed off on. And 5 years later, he was one of only 15 still left in Congress (and that number has dwindled even since then).

(95,201 posts)My goal is to get the most Democrats elected. While maintaining ones LEGAL rights to criminal defense, that doesnt extend to political support. If the indictment is reputable, Im willing to cast the candidate aside and look for alternatives.
