The cops were wearing yellow vests like road workers and it's quite likely that he didn't know a police officer was speaking to him.

He already has a lawyer, this is not going to go well, the charges are very serious. The prosecutors office needs to get involved by rejecting the cops request for charges, and try to avoid a lawsuit.
