immigration is a prerogative of president and congress. I dont think SC wants to create this kind of precedent. Its totally different from Bush v gore. Under current federal law daca folks were subject to deportation until the executive order. But the EO has not changed the law and it was reveresed which is common thing to do when new admin takes over.

At the same time, it might muddle things a lot.
Esp. if there's any twinge of an opinion on something other than process and procedure, which is where the courts have been hewing to.
