(44,498 posts)There are numerous other criminal actions he could be charged with, including criminal conspiracy, Logan Act, failing to register as a foreign agent, probably various financial crimes.
He received the single count as part of the plea bargain, so that the sentence would be appropriately light. If the plea falls through, expect Flynn to be hit with a slew of additional charges.

(130,533 posts)"a fair and just reason," not just because they want to. What would that reason be in Flynn's case? He probably has spilled his guts to Mueller already, but they won't be sentencing him until after May 1, when the report is due. So maybe he's angling for a lighter sentence? Not sure what, if any, leverage he has, other than not making the prosecutors go to trial. Which isn't much.

(130,533 posts)for him to withdraw his guilty plea, because a pardon gets him off the hook only for the penalty; a condition for a pardon is generally held to be an acknowledgment of guilt (unless the person claims to be factually innocent). Since Flynn has pled guilty only to a single count of lying to the FBI, the penalty will probably be fairly light anyhow (maybe a year or two in a minimum security prison). A pardon would mean that he wouldn't have to serve the sentence. If he withdrew the guilty plea and got pardoned before he went to trial or had to serve any time, the result would be the same. I think there has to be another reason.

(16,698 posts)Usually plea deals insist that you tell the truth, and you tell EVERYTHING that you know/did. Very likely Mueller found out more stuff that Flynn didn't report so he is going to charge him. As such, Flynn would presumably withdraw his guilty plea as part of a larger defense strategy for the upcoming trial.

(1,067 posts)Yesterday my news feed which is Google on my phone posted some article from a legal site run by Dan Abrams. The gist of the article was that the Mueller investigation was corrupt and that the evidence against Flynn was illegally obtained through the FISA court. Maybe Flynns Attorney's think that there is compelling evidence that was withheld from Flynn and his defense team. Not an attorney but I am damn sure that Mueller checked those warrants front to back. You do not charge a retired 2 star general with a crime unless you have all your ducks in a row. Let him withdraw his plea and I guarantee you that Michael Flynn Jr. will be doing the perp walk soon. Trumps people are stupid and arrogant and they is a bad mix. Flynn could lose all the privileges of his rank if he withdraws his plea and is subsequently convicted. Innocent people do not plea guilty.
