(53,061 posts)A federal judge on Monday rejected an attempt by President Trump and his longtime personal lawyer, Michael D. Cohen, to block prosecutors in Manhattan from reviewing a trove of materials seized in F.B.I. raids last week on Mr. Cohens office, home, hotel room and safe deposit box.
But feeling her way toward a resolution of the clash involving Mr. Trump and prosecutors investigating Mr. Cohen, the judge, Kimba M. Wood, signaled that she was considering appointing a special master to assist prosecutors if and when they cull through documents seized in the raids.

Judge Rejects Trumps Request to Review Seized Cohen Materials via @NYTimes https://nyti.ms/2JP9bj5

(58,724 posts)Judge Kimba Wood, a judge in the U.S. District Court for the Southern District of New York, ruled that the government must allow Cohens legal team to review materials that the FBI seized from his office, home and hotel room last week. Wood ruled that Cohen's legal team will see the materials before the federal prosecutors investigating Cohen are allowed access to them, according to multiple reports.

(1,517 posts)A federal judge dealt a blow to Michael Cohen, the presidents embattled personal lawyer, in a closely watched court decision on Monday afternoon.
Judge Kimba Wood of federal District Court in Manhattan denied an attempt by Cohen and President Trump to stop prosecutors from reviewing the materials that the FBI seized from his office, home and hotel room last week, according to multiple reports.
Cohen's legal team had asked for a temporary restraining order so that they could review the files and then turn over to prosecutors those that were "responsive, non-privileged items" a request the government called unprecedented.
But in a victory for Cohen, Wood did order the government to create a database of what was taken from Cohen and share it with his legal team, according to The Associated Press.

(8,203 posts)left field.....don't know....
The argument against such an extraordinary request..
U.S. District Judge Kimba Wood on Monday will consider Trumps extraordinary request to let the presidents attorneys conduct the document review for information protected by attorney-client privilege before Justice Department lawyers can look at it.
Under the presidents theory, every person who has communicated with a lawyer would be given the power to turn every search warrant into a subpoena and to demand the return of lawfully seized evidence, the prosecutors wrote in a letter Monday. Such a rule is unworkable and ripe for abuse.
Don't know..just don't know when this newsweek ruling came down....

(21,946 posts)special master if needed. At any rate, cohen will not get the documents first and at best he can look at copies of what the FBI has. As far as all the electronic stuff, they just copied off what they wanted and left the stuff on his computer.

MORE: U.S. Attorneys "taint team" to put seized documents into searchable database for Trump, Cohen attorneys, in advance of meeting among judge and parties to determine how much material is privileged. The process could up to two weeks.

(7,288 posts)Wood did not rule that Cohen's team could review the evidence before the prosecutors. Your ABC cite is correct.

(58,724 posts)Here's the Newsweek lead paragraph:
President Donald Trumps personal lawyer, Michael Cohen, will get to review the documents that the government seized from him before prosecutors do, a federal judge ruled Monday. After the documents are provided to Cohen and his attorneys, the judge will decide whether a special government filter team or a so-called "special master" will get to further review the documents for those that might be covered by attorney-client privilege.

(7,288 posts)Cohen and his team do not get to review documents BEFORE the prosecutors.

The judge in the Michael Cohen case has denied Cohens bid to have the government blocked from going through the materials they seized last week from his offices and hotel room. But she outlined a process where both sides will go though the documents for privileged material. The government cant look at the substance of the materials, beyond the narrow search. The judge did not rule out appointing a special master to look through the materials, but said shed decide at a future hearing ...
