(12,344 posts)If they are conspiring to commit a crime, it's not priveleged. If it's a theoretical discussion, like "Is this a crime?" then it's privileged. Smart criminals keep it "theoretical." Dumb ones, well, we are talking about Trump here, so...

(5,633 posts)Listen to any, or use any, privileged information a listener could glean from a conversation.
The chances Trump was on that call is ridiculously small, and the chance he would discuss incriminating information without 100% knowing who was on the line is infinitesimally smaller.
They probably heard a conversation between Cohen and Dowd, Cobb or McGahn relating to document possession and submission. Since that would be Trumps legal team discussing legal strategy, that call would be covered by attorney-client privilege.

(16,799 posts)He's arrogant, Dowd and Cobb left, it's been reported that he and McGahn aren't exactly on cordial term...and Ghouliani dropped the soap on Hannity!!!
So it's very likely that Trump talked to Cohen without his legal "team" even knowing about it...and only the FBI knows what was discussed...and investigators along with the court will decide if the conversation was privileged!
Saviolo
(3,321 posts)... and keep in mind, this is just what people with more knowledge of the process than I have been saying in a theoretical sort of way, is that the call discussed not possession and submission of documents, but destruction of them. That discussion would not be covered by a-c privilege as it is discussion about committing a crime.

CORRECTION: Earlier today, NBC News reported that there was a wiretap on the phones of Michael Cohen, President Trumps longtime personal attorney, citing two separate sources with knowledge of the legal proceedings involving Cohen.
But three senior U.S. officials now dispute that, saying that the monitoring of Cohens phones was limited to a log of calls, known as a pen register, not a wiretap where investigators can actually listen to calls.
NBC News has changed the headline and revised parts of the original article.
Federal investigators have monitored the phone lines of Michael Cohen, the longtime personal lawyer for President Donald Trump who is under investigation for a payment he made to an adult film star who alleged she had an affair with Trump, according to multiple senior officials and individuals with knowledge of the legal proceedings involving Cohen.
