Rudy Giuliani said Sunday that President Trump would not have to comply with a subpoena in special counsel Robert Muellers investigation into Russian meddling in the 2016 election.
We dont have to [comply with a subpoena]. Hes the president of the United States. We can assert same privilege as other presidents have," Giuliani said on ABCs This Week.
Giuliani, who was recently hired to lead Trumps legal team in the Russia probe, said hed prefer the president receive the Hillary Clinton treatment. He said that would involve answering questions that were received in advance, while not under oath.

No, hes going to need to comply with a subpoena. If they take that case to court, theyre going to lose, Schiff told CNNs State of the Union.
CNNs Jake Tapper had specifically asked Schiff about remarks from Giuliani, who told ABCs This Week that the president would not need to comply with a subpoena from Mueller."

(5,586 posts)The DOJ has had a policy since the year 2000 that the active President cannot be prosecuted while he is in office, and I don't see management of this DOJ changing that opinion anytime soon. If he cannot be prosecuted, then he cannot be charged with a crime, and Mueller cannot just send out the cops to arrest him and make him appear.
In any case, to force Trump's appearance, Mueller will have to bring a case through the court system, which could take years. Mueller will have to decide if he wants to fight this for that long, and if interviewing Trump is absolutely necessary to advance his cases. Trump can always exercise his 5th amendment rights and decline to say anything as well.

(3,515 posts)What if Trump were to be sued for negligence by someone who died in an accident during the campaign to be president? Wouldn't he have to answer a subpoena? This is no different.
What if Trump is called in a case against one of his companies for a death in a fire in one of his apartments, called to testify about safety precautions in the building? It isn't likely, but it is possible.
Trump is not above the law even if he is president. Seems to me.
The primary events at issue in Mueller's case occurred during the campaign. At the very least, he was not president then. And Clinton answered for far less problematic behavior to the Starr prosecution team when he was president.

She suspects Mueller won't insist: "It's trump's chance to tell his side of the story, and he doesn't have to if he doesn't wish to."
Gooliani's tv appearance leaves campaign finance crimes unanswered.
She guessed that mueller would send up indictments before the nov election. Oooohhhh!!!
