JUST IN: Giuliani: Trump doesn't have to comply with a subpoena from Mueller




Rudy Giuliani said Sunday that President Trump would not have to comply with a subpoena in special counsel Robert Mueller’s investigation into Russian meddling in the 2016 election.

“We don’t have to [comply with a subpoena]. He’s the president of the United States. We can assert same privilege as other presidents have," Giuliani said on ABC’s “This Week.”

Giuliani, who was recently hired to lead Trump’s legal team in the Russia probe, said he’d prefer the president receive the “Hillary Clinton treatment.” He said that would involve answering questions that were received in advance, while not under oath.

"Rep. Adam Schiff (D-Calif.) said Sunday that President Trump would need to comply with a subpoena from special counsel Robert Muller even though the president's lawyer, Rudy Giuliani, said that Trump would not need to do so.

“No, he’s going to need to comply with a subpoena. If they take that case to court, they’re going to lose,” Schiff told CNN’s “State of the Union.”

CNN’s Jake Tapper had specifically asked Schiff about remarks from Giuliani, who told ABC’s “This Week” that the president would not need to comply with a subpoena from Mueller."

13. Trump would probably lose, but with this SC, you never know. But it is complicated.

The DOJ has had a policy since the year 2000 that the active President cannot be prosecuted while he is in office, and I don't see management of this DOJ changing that opinion anytime soon. If he cannot be prosecuted, then he cannot be charged with a crime, and Mueller cannot just send out the cops to arrest him and make him appear.

In any case, to force Trump's appearance, Mueller will have to bring a case through the court system, which could take years. Mueller will have to decide if he wants to fight this for that long, and if interviewing Trump is absolutely necessary to advance his cases. Trump can always exercise his 5th amendment rights and decline to say anything as well.

3. The only reason Hillary was interviewed was because the Republican had a hissy fit

The FBI had already reached their determination that the whole thing was a big zero but the Republicans were clamoring for an interview so the FBI went through the motions to appease them.

4. Giua911ni has been around too many mob attorneys. Now he acts like one.

Something happened to that guy when he was NY prosecutor. He now thinks of himself as some kind of "mob celebrity."

He's just like trump is, a serial liar who is stupid with facts, and can only use propaganda to promote themselves with. He never wanted to talk to Mueller, and trump's lying about wanting to. Its all another act, a con that he would do it. All for pr.

What if Trump were to be sued for negligence by someone who died in an accident during the campaign to be president? Wouldn't he have to answer a subpoena? This is no different.

What if Trump is called in a case against one of his companies for a death in a fire in one of his apartments, called to testify about safety precautions in the building? It isn't likely, but it is possible.

Trump is not above the law even if he is president. Seems to me.

The primary events at issue in Mueller's case occurred during the campaign. At the very least, he was not president then. And Clinton answered for far less problematic behavior to the Starr prosecution team when he was president.

15. This question up on msnbc right now Alex Wittless.

Barbara McQuade, ex U.S. attorney, says 45 would have to appear and plead the 5th every time a question was asked.

She suspects Mueller won't insist: "It's trump's chance to tell his side of the story, and he doesn't have to if he doesn't wish to."

Gooliani's tv appearance leaves campaign finance crimes unanswered.

She guessed that mueller would send up indictments before the nov election. Oooohhhh!!!

14. Now what was it "they" said about electing Hillary leading to constant court battles?

Really it makes me laugh now that the threat of her being part of court cases was such a scare tactics for the right. They voted for the king of swarmy court cases.
