AG is a supervisory position, so where she is barred doesnt matter.

(6,974 posts)Right. The AG has to have a current law license, and Hillary's law license lapsed as she was winning her seat as Jr. Senator of NY in the early 2000's.
I'd love to see Hillary stick it to Fatso, but if she were appointed as NY State AG, that would be a mess. Not because of her, but because of thuglicans, the corporate media and tRump would be tweeting about that all day. Crooked H. this, Crooked H. that. People who were angry that she won the Dem nomination would go in on her. Then Faux Noose would chime in 24/7 with LIE after LIE about Hillary. Then Alex Jones would bring up Pizza gate and the 1,0001 LIES about her murdering Vince Foster MORE condemnation of her by the likes of Andrea Mitchell and the like.
NO, I'm enjoying the mess that is Fatso and Ghouliani who tRumputin will be replacing very soon IMHO. Ghouliani's making a mess as Fatso's mouthpiece. GOOD

However, I think she would be required to recuse herself from anything Trumpster related because . . . political history and ethics. Ethics is something the Trumpster wouldn't recognize if he stumbled over them. But for Hillary Clinton? She is an ethical person.
Plus, I strongly doubt she'd be interested.

As satisfying, and probably efficacious as well, that it would be, it's a non-starter, I bet. It might make people start stamping their feet and yelling, and elected Democrats don't do that. Not of they can help it.

(1,095 posts)The person appointed now will only be there until November. Too bad the Governor didn't call for an investigation and then fire him if the accusations were proven true. This jeopardizes the cases against Trump and Cohen. Especially if a republican wins in November.

(713 posts)Preet Bharara would be a much more realistic choice. Hillary has never been a Prosecutor. Preet is highly skilled, experienced, and competent. His character seems to be very good also.

(713 posts)The US Attorney General (Sessions) has no authority over the New York State Attorney General, which is the Office that Schneiderman is resigning from. One is Federal (Sessions) and the other is New York State (Schneiderman). Preet used to be a US Attorney General for the Southern District of New York, a Federal Office. If Preet were appointed, he would be a New York State AG, no longer a Fed.
Again- The New York State AG is part of the New York State Government. It is entirely separate from the Federal Government. The Federal Justice Department and the New York State Attorney General's Office are entirely independent of each other. One is State, the other Federal, both with separate powers, different laws (State versus Fed), and different governments. Sessions would not have the power to fire the NYS AG.
If Preet were appointed, he would have to run for election in November anyway. I think it would be good to appoint him, since as a sitting NYS AG, he would be in a stronger position to defeat whatever Republican who might run against him in the Fall. It would also be poetic justice if Preet were elected, since he would then be in a position to investigate any State Crimes committed by Trump and his Lackeys, who are the people that were dumb enough to fire him in the first place.
Also, as has been pointed out by others, the President has no Power to issue Pardons over State charges. Trump could only issue Pardons for those convicted of Federal Crimes. The NYS AG can investigate and prosecute Trump and his Chronies under State Law, completely separate from the Feds. Completely different jurisdictions.
Preet would be a strong candidate, given his previous work as a U.S. Attorney (Federal). He is also known in New York State political circles as the guy who brought corruption charges against allegedly corrupt New York State Legislature leaders. That would be Dean Skelos, a former Republican State Leader, and Sheldon Silver, a former Democratic State Leader, both former leaders in the State Legislature that Preet brought charges against (still working its way through the Courts).
Preet would make an excellent NYS Attorney General, for a number of reasons, including his experience bringing Federal corruption charges against those former New York State Government figures. As I said, it would also be poetic justice if Preet ended up prosecuting Trump and his Cronies, for crimes. They were the people dumb enough to fire him from his US Attorney position to begin with.

(713 posts)Sometimes it is hard to sort out different things when different branches of government involved. It can be confusing to know who is a Fed, who is a State Officer, etc. Federal versus State Government can be complex. They teach entire courses on this stuff in College Political Sciences Departments, so a lot of it is not just common knowledge. It can confuse even professional political science people.

(713 posts)Yates is a great person, but as has been pointed out, she is from Georgia. Preet is originally from New Jersey, but has been a New Yorker for a very long time. He and his Family live in Westchester. He graduated from Columbia Law School and was the US Attorney for the (Federal) Southern District of New York.
I think that Yates is a rising star though, and certainly has the potential to work in a lot of different capacities, maybe US Attorney General when we get the next Democratic Presidency, which will hopefully be in 2021. Maybe a run for US Senate out of Georgia, where I believe that both current Senators are Republicans?
Anyway, the New York State Attorney General is a State Office, and needs to be a New Yorker, which Preet is. He is also qualified in spades for the job.
