I cant believe there is a more logical good choice to be AG but maybe we save Preet for US Attorney General and pick a more political type for this job.

(58,785 posts)50 governors, 50 stateAGs. Never having lived in NY, I don't feel special concern at the possibility that NY's specially greased path to the presidency goes unused for a while.
In this case, I'm thinking the concern should be the immediate need: Who best to fulfill its hugely important functions as the Trump-Russia and other big investigations continue?

(10,132 posts)None of the 6 New Yorkers who became president were former attorneys general (a few governors, though). Being Secretary of State is a more common step on the career path (Jefferson, Madison, Monroe, JQ Adams, Van Buren, Buchanan) and as William Jennings Bryan and Hillary Clinton can remind you that's not a shoo-in either.
The only sure-fire path to the presidency is being the sitting VP when the incumbent dies or is otherwise removed from office.

An extra two percent chance out of New York, an extra one percent out of Florida, an extra three percent out of Wisconsin, the little extra edges can add up. If we can up the odds five percent in our lifetime that can be five percent of saving a million more lives. You have a better way to do good?

(45,411 posts)There have been plenty of immigrants elected to all sorts of offices. We shouldn't block someone out from being a state attorney general because he's an immigrant. That's some Trumped up logic.
What was Trump's path to the presidency? Which office did he hold before being elected president?

(56,828 posts)One house is nominally controlled by the GOP. The state assembly - which would control the appointment process - has a Democratic majority of 105-41 and a Democratic speaker.

It's all laid out in Section 41 of the state's Public Officers Law, according to Bennett Liebman, Albany Law School's government lawyer-in-residence.
The law reads, in part: "When a vacancy occurs or exists, other than by removal, in the office of comptroller or attorney-general ... the two houses thereof, by joint ballot, shall appoint a person to fill such actual or prospective vacancy."
It will be up to legislative leaders when to call the session. "

NY State Assembly is 105-41 Democrats, with 4 seats vacant
NY State Senate is 32-31 Republican when you have 1 Democrat voting as a Republican.
213 total seats
107 seats are needed to confirm a nominee

(56,828 posts)The vote to replace Schneiderman will be done by a joint session and controlled by Assembly Speaker Carl Heastie, a Democrat. Democrats have an overall overwhelming numbers advantage due to a more than 2.5 to 1 ratio in the state assembly.

(94,489 posts)The Assembly and Senate vote as a combined group. There are way more Democrats. The only the the Senate can do is hold up the vote procedurally, in which case Cuomo's interim appointment (hint: a Democrat) remains in office until the newly elected AG takes office.

I see a lot of people tweeting @PreetBhararas name as a possible Schneiderman replacement.
The chances of the NY Legislature home to many he once prosecuted picking him are less than zero.

(10,132 posts)as NY AG is that we'll be deafened by the howls from the Trumpsters about how he's out for revenge since Donnie Two Scoops fired him. I would think that being an honorable person, though, Bharara would recuse himself from the case at hand and leave it in the capable hands of the people who are currently doing the work.
